It is unlikely that we would be able to support a variance to locate the <br />fence closer than 2' from the sidewalk based on the variance criteria outlined in EMC 15.03.140. <br />can approve the public works permit for planning now and add a note to the plans that states the fence must be <br />setback 2' from the sidewalk. Is there a process available to get an exception to the 2' rule? Due to how close <br />our home is to the sidewalk, we would have to look at putting the gate at a different location and <br />not aligned to the front door. I see numerous other houses/businesses have been allowed to install at <br />the sidewalk.
