It is unlikely that we would be able to support a variance to locate the fence closer than 2' from the sidewalk based on the variance criteria outlined in EMC 15.03.140. can approve the public works permit for planning now and add a note to the plans that states the fence must be setback 2' from the sidewalk. Please let me know how you would like to proceed. Due to how close our home is to the sidewalk, we would have to look at putting the gate at a different location and not aligned to the front door. I see numerous other houses/businesses have been allowed to install at the sidewalk. The Salvation Army on Rucker not only is closer than 2' but also well above the 42" restriction.
