10 <br /> <br />ARTICLE 7 - MANAGEMENT RIGHTS <br />The management of the City and the direction of the work force are vested exclusively in the City unless <br />otherwise expressly provided by the terms of this Agreement. The City has the right to manage and operate the <br />Fire Department in its discretion, and to adopt rules for the operation of the Department and the conduct of its <br />employees, provided such management, operation and rules are not controlled by the terms of this Agreement or <br />by applicable law. Examples of such rights include the right: <br />A. To recruit, hire, transfer within the Fire Department, promote or lay off employees; <br /> <br />B. To suspend, demote and/or discharge employees or take other disciplinary action; <br /> <br />C. To schedule meetings for all supervisory personnel; <br /> <br />D. To assign work and determine the location and the number of personnel to be assigned duty at any time It <br />is understood by the parties that every incidental duty connected with fire service oriented operations <br />enumerated in job descriptions is not always specifically described. The City agrees that work <br />assignments shall be limited to Fire Department duties. <br /> <br />E. To control the departmental budget, including its allocation for equipment and supplies. <br /> <br />F. To hire or promote and place employees in civil service classifications even when a vacancy doesn’t exist. <br /> <br />G. Administrative leave: <br /> <br />The City has the right to place employees on paid administrative leave. The City may use administrative leave <br />with pay as a means of placing employees in an off-duty capacity during times that they are otherwise <br />scheduled to be on duty. Examples where administrative leave with pay may be used, if appropriate, would <br />include, but not be limited to investigations or fitness for duty exams. Individuals on paid administrative leave <br />must be available and responsive during their regular work schedule. Individuals on Paid Administrative <br />Leave are not subject to overtime, callout shifts, or any additional duties. Employees on Paid Administrative <br />Leave will earn their regular rate of pay, plus premiums they would have ordinarily received as part of their <br />shift such as specialty premium. <br />
