40 <br /> <br />ARTICLE 28 - PERSONNEL REDUCTION <br />In the case of a personnel reduction, the employee with the least seniority shall be laid off first. Time in the Fire <br />Department shall be given the utmost consideration. The involved employee shall have the opportunity of taking <br />up to one (1) year’s leave of absence as an option prior to a layoff. No new employee shall be hired until the laid <br />off employee or individual on leave of absence has been given the opportunity to return to work. <br /> <br />The employee shall be given a complete physical examination when he/she is laid off, and upon recall to duty, <br />must be reasonably able to meet the aforementioned physical standard. <br /> <br />Any employee holding a permanent appointment above first class firefighter shall be given the opportunity to <br />return to his original rank at the time of the reduction before anyone is promoted to that rank. <br />
