4) Pressure to change the land use designation of other properties in the vicinity <br /> outside the present location should be discouraged; and <br /> WHEREAS,with regard to the Hofmann property located at the southwest corner of 19th <br /> Street at McDougall Avenue, the City Council further finds: <br /> 1) The purpose for the requested land use map amendment is to create consistency <br /> between the commercial use of the site and the associated land use designaiton; and <br /> 2) The applicant has offered, in testimony before the Planning Commission, a <br /> willingness to keep the residential portion of the site under current residential designaiton <br /> of Single Family 10-12 Dwellings per acre and R-2 zone; and <br /> 3) The requested amendment to the land use map and rezone promotes the public <br /> health, safety and welfare and the long term interests of the Everett Community provided <br /> development of the subject property is conditioned according to the stipulations, <br /> restrictions and provisions found herein; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Land Use Map amended: The Everett Comprehensive Plan map land use <br /> designation for the Hofmann property located at the southwest corner of 19th Street at <br /> McDougall Avenue, as depicted on the attached"Exhibit A," as adopted by Ordinance <br /> #2021-94, is hereby amended from Single Family 10-12 Dwelling Units per Acre to <br /> General Commercial -Multi Family with the proviso that the residence and that portion <br /> of the property historically associated with it, shall be regulated as if it were zoned R-2, <br /> such provision being enforced by use of a development agreement. <br /> Section 2: Validity: That should any section, subsection, paragraph, sentence clause or <br /> phrase set forth in this Ordinance or its application to any person or situation be declared <br /> unconstitutional or invalid for any reason, such decision shall not affect the validity of the <br /> remaining portions of this Ordinance or its application to any other person or situation. <br /> The City Council of the City of Everett hereby declares that it would have adopted this <br /> Ordinance and each section, subsection, sentence, clause, phrase or portion thereof <br /> irrespective of the fact that any one or more sections, subsections, sentences, clauses, <br /> phrases or portions be declared invalid or unconstitutional. <br /> Section 3: Benefit to Public Health, Safety and Welfare: It is expressly the purpose of <br /> this Ordinance to provide for and promote the health, safety and welfare of the general <br /> public and not to create or otherwise establish or designate any particular class or group <br /> of persons who will or should be especially protected or benefited by the terms of this <br /> Ordinance. <br />
