3rd Interim Action Construction Report <br />Kimberly-Clark Upland Site <br /> 0121049.080.084 <br />July 30, 2024 2-1 landauinc.com <br />2.0 IMPLEMENTATION OF THE INTERIM ACTION <br />The Project, which included implementation of the Interim Action, commenced in October 2021 and <br />concluded in May of 2023. Interim Action portions of the Project generally included site grading, cap <br />construction, utility installation, outfall reconstruction, soil and groundwater management, and security <br />fencing installation. Preload ground improvement activities to support cap construction were conducted <br />in portions of the Site prior to approval of the Work Plan; this work was proposed in the Preload Ground <br />Improvement technical memorandum (Preload Memo) that was approved by Ecology, which was <br />included as an attachment to the Work Plan. Preloading activities are discussed in this report as a part of <br />the Interim Action. <br />2.1 Ecology Coordination and Permitting <br />The Interim Action was implemented in accordance with the second amendment to the AO. In addition <br />to Ecology approval of the Work Plan, the Port maintained consistent communication with Ecology’s Site <br />manager, Andy Kallus, during the Project, which included weekly coordination meetings, requests for <br />reviews of contractor submittals, and general updates of observations at the Site. <br />The Port also obtained the following permits and approvals for the Project: <br />• NOAA Fisheries Section 7 Endangered Species Act (ESA) Letter of Concurrence (February 10, <br />2021) <br />• US Fish & Wildlife Section 7 ESA Letter of Concurrence (March 11, 2021) <br />• US Army Corps of Engineers Nationwide Permit 7 Authorization (June 14, 2021) <br />• City of Everett Shoreline Substantial Development Permit, Height Modification, and Landscaping <br />Modification Approval (September 23, 2021) <br />• Washington State Department of Archaeology and Historic Preservation No Historic Properties <br />Affected Concurrence Letter (March 17, 2021) <br />• Port State Environmental Policy Act mitigated determination of non-significance (March 8, 2021) <br />• Ecology Administrative Order for compliance with Water Pollution Control Act, Water Quality <br />Standards, and National Pollutant Discharge Elimination System Construction Stormwater <br />General Permit (CSGP; August 3, 2021) <br />• Washington State coverage under the CSGP (August 6, 2021) <br />• City of Everett Public Works Permit (October 26, 2021) <br />• Maritime Administration National Environmental Policy Act Record of Categorical Exclusion <br />(April 15, 2021) <br />• City of Everett Letter of Substantive Requirements (August 10, 2021) <br />• Washington Department of Fish & Wildlife Letter of Substantive Requirements of the Hydraulic <br />Code (July 8, 2021). <br />Copies of permits and approvals are held by the Port and can be provided upon request.
