At the discretion of the Contracting Agency, this procedure <br />15 for Minor Changes may be used in lieu of the more formal procedure as outlined in Section <br />16 1-04.4, Changes. All Minor Change work will be within the scope of the Contract Work <br />17 and will not change Contract Time. <br />18 <br />19 1-05.7.RTF <br />20 1-05.7 Nonconforming Work <br />21 (February 17, 2026 APWA GSP) <br />22 <br />23 Supplement this section with the following: <br />24 <br />25 The rights exercised under the provisions of this Section shall not diminish the <br />26 Contracting Agencys right to pursue any other avenue for additional remedy or damages <br />27 with respect to the Contractors failure to perform the Work as required. The Engineer <br />28 has the right to reject all or part of the Nonconforming Work, and the Engineers decision <br />29 is final and not subject to protest. <br />30 <br />31 No additional contract time or compensation will be allowed when the Contracting <br />32 Agency exercises their rights provided by this Section. <br />33 <br />34 1-05.7(1) Identification of Nonconforming Work <br />35 Replace this section with the following: <br />36 <br />37 The Contractor is responsible for quality control and shall identify all Nonconforming <br />38 Work. The Contracting Agency may also identify Nonconforming Work. However, failure <br />39 by the Contracting Agency to identify Nonconforming Work shall not relieve the <br />40 Contractor from their responsibility for the quality of the Work, nor shall it constitute <br />41 acceptance or approval of the Nonconforming Work. <br />42 <br />43 1-05.7(2) Reporting of Nonconforming Work <br />44 Replace this section with the following: <br />45 <br />46 The Contractor shall immediately report all Nonconforming Work to the Engineer and <br />47 shall include any relevant information known for suggested remediation of <br />48 Nonconforming Work. <br />49 <br />50 When the Contracting Agency identifies Nonconforming Work, the Engineer will notify <br />51 the Contractor in writing specifying a time when a remedy must be complete.
