2026 Pavement Maintenance Overlay Special Provisions <br />PW# 3860 SP - 23 March 5, 2026 <br />1 apprentice hour total. If the new utilization percentage meets the Contract requirement, <br />2 the Contractor will be reported as meeting the requirement in good faith. <br />3 <br />4 Approving Good Faith Efforts <br />5 The Contracting Agency will review submitted Good Faith Efforts and issue a <br />6 determination. The Engineer may request additional information, documentation, <br />7 evidence or similar in order to approve such efforts. A determination by the Engineer is <br />8 final. The approved Good Faith Efforts will be loaded into the PWIA system by the <br />9 Contracting Agency. <br />10 <br />11 Measurement <br />12 Apprenticeship hours used to calculate the item Apprentice Incentive/Penalty, by <br />13 calculation, will be measured for each hour of Work performed by an apprentice as <br />14 shown on the Monthly Apprentice Utilization Report, based on certified payrolls or the <br />15 affidavits of wages paid, whichever is least. The percentage is not rounded up. The <br />16 calculation of incentive/penalty will be assessed based on the Final Payment for <br />17 Contractors who meet the Apprentice Utilization Requirement without a reduction by <br />18 Good Faith Effort. <br />19 <br />20 Payment <br />21 Payment will be made for the following Bid Items when included in the proposal: <br />22 <br />23 Apprenticeship Incentive/Penalty, by calculation. <br />24 <br />25 When the Contractor meets the apprenticeship requirement of 15% an incentive will be <br />26 assessed. When the Contractor fails to meet the apprenticeship requirement of 15%, a <br />27 penalty will be assessed for each hour that is not achieved, unless a Good Faith Effort is <br />28 approved by the Contracting Agency. <br />29 <br />30 Apprenticeship Incentive/Penalty will be calculated as described below: <br />31 <br />Percent of <br />requirement met Incentive <br />Penalty per hour <br />of unmet <br />requirement <br />100%***$5,000 Lump <br />Sum ***N/A <br />90% to 99%N/A ***$2.00*** <br />75% to 89%N/A ***$3.50*** <br />50% to 74%N/A ***$5.00*** <br />1% to 49%N/A ***$7.50*** <br />0%N/A ***$10.00*** <br />32 <br />33 For the purpose of providing a common proposal for all bidders, the Contracting Agency <br />34 has entered an Incentive amount in the proposal to become a part of the total bid by the <br />35 Contractor. <br />36 <br />37 The Contractor shall include all related costs in the unit Bid prices of the Contract, <br />38 included but not limited to implementing, developing, documenting, and administering an <br />39 apprenticeship utilization program, recording and reporting hours and all other costs to <br />40 comply with this provision.
