2026 Pavement Maintenance Overlay Special Provisions <br />PW# 3860 SP - 30 March 5, 2026 <br />1 <br />2 1-07.18(5)C Workers Compensation <br />3 The Contractor shall comply with Workers Compensation coverage as required by the <br />4 Industrial Insurance laws of the State of Washington. <br />5 <br />6 f1-07.18(5)D.RTF.docx <br />7 1-07.18(5)D Excess or Umbrella Liability <br />8 (January 4, 2016 APWA GSP) <br />9 <br />10 The Contractor shall provide Excess or Umbrella Liability insurance with limits of not less than <br />11 *** $2 *** million each occurrence and annual aggregate. This excess or umbrella liability <br />12 coverage shall be excess over and as least as broad in coverage as the Contractors <br />13 Commercial General and Auto Liability insurance <br />14 <br />15 All entities listed under 1-07.18(2) of these Special Provisions shall be named as additional <br />16 insureds on the Contractors Excess or Umbrella Liability insurance policy. <br />17 <br />18 This requirement may be satisfied instead through the Contractors primary Commercial <br />19 General and Automobile Liability coverages, or any combination thereof that achieves the <br />20 overall required limits of insurance. <br />21 <br />22 1-07.18(5)J.RTF <br />23 1-07.18(5)J Pollution Liability <br />24 (January 4, 2016 APWA GSP) <br />25 <br />26 The Contractor shall provide a Contractors Pollution Liability policy, providing coverage for <br />27 claims involving bodily injury, property damage (including loss of use of tangible property that <br />28 has not been physically injured), cleanup costs, remediation, disposal or other handling of <br />29 pollutants, including costs and expenses incurred in the investigation, defense, or settlement <br />30 of claims, arising out of any one or more of the following: <br />31 1. Contractors operations related to this project. <br />32 2. Remediation, abatement, repair, maintenance or other work with lead-based paint or <br />33 materials containing asbestos. <br />34 3. Transportation of hazardous materials away from any site related to this project. <br />35 <br />36 All entities listed under 1-07.18(2) of these Special Provisions shall be named by <br />37 endorsement as additional insureds on the Contractors Pollution Liability insurance policy. <br />38 <br />39 Such Pollution Liability policy shall provide the following minimum limits: <br />40 *** $2,000,000 *** each loss and annual aggregate <br />41 <br />42 1-07.18(5)K.RTF <br />43 1-07.18(5)K Professional Liability <br />44 (December 30, 2022 APWA GSP) <br />45 <br />46 The Contractor and/or its subcontractor(s) and/or its design consultant providing construction <br />47 management, value engineering, or any other design-related non-construction professional <br />48 services shall provide evidence of Professional Liability insurance covering professional <br />49 errors and omissions. <br />50 <br />51 Such policy shall provide the following minimum limits: <br />52 $1,000,000 per claim and annual aggregate
