Exhibit B <br />ORDINANCE Exhibit A - Page 58 of 66 <br />g. Replacement of the habitat functions and values that are impacted by development. <br />5. Also in accordance with RPA-3.A.3.b, where conditions permit, the city shall require <br />development within the one-hundred-year floodplain to use low impact development (LID) <br />methods consistent with the city’s stormwater management regulations, to minimize or avoid <br />stormwater effects. <br />6. All development proposals shall follow the mitigation sequence of EMC 19.37.100 to <br />achieve no net loss of ecological functions and values. <br />7. When development occurs in floodplain areas, the portion of the site not elevated above the <br />one-hundred-year flood elevation shall be designed to create floodplain refugia and prevent <br />stranding of aquatic species during flood events to the maximum extent practicable. <br />8. Restoration of fish habitat either on site or off site is allowed in order to mitigate for habitat <br />impacts caused by development within the floodplain. Restoration and mitigation for impacts <br />may occur in areas which flood more frequently than the area proposed for development (e.g., <br />tidal restoration project that provides greater habitat benefits to juvenile salmonids). <br />9. The city shall have the authority to require changes in the design of a development if <br />necessary to avoid, minimize or mitigate impacts to endangered species or habitat for such <br />species. <br />D. Additional Critical Area Report Content for Biological Assessments (BA). Biological Assessments must <br />conform with 2010 FEMA Region X Regional Guidance - Floodplain Habitat Assessment and Mitigation. <br />Refer to the requirements for habitat assessments in this subsection. <br />E. Additional Critical Area Report Content for Habitat Assessment and Habitat Management Plans <br />(HMP). <br />1. Habitat Assessment. All habitat assessments required by this chapter shall include the <br />following elements in addition to the general requirements for all critical area reports listed in <br />this section: <br />a. A detailed description of the vegetation on and adjacent to the site. <br />b. Identification and a detailed description of any critical fish or wildlife species or <br />habitats, including listed threatened or endangered species, as set forth in this chapter, <br />on or adjacent to the site and the distance of such habitats or species in relation to the <br />site. Describe efforts to determine the status of any critical species in the project area, <br />including information on survey methods, timing, and results of surveys for species or <br />suitable habitat identification. <br />c. Include any information received from biologists with special expertise on the species <br />or habitat type, such as WDFW, Tribal, USFS, or other local, regional, federal, and <br />university fish, wildlife and habitat biologists and plant ecologists. Include any such <br />conversations in the habitat assessment and cite as personal communication.
