Exhibit B <br />ORDINANCE Exhibit A - Page 12 of 66 <br />receiving site in a Neighborhood Residential zone, the planning <br />director shall have the authority to allow for a reduction of the <br />minimum lot area allowed by the zone in which the receiving <br />site is located by not more than twenty percent. The director <br />shall have the authority to reduce the required lot width and <br />depth by not more than twenty percent. All dwelling units on <br />such lots shall be one-unit dwellings. <br />(B) Urban Residential Zones. The amount of development transferred <br />to the receiving lot shall be limited only by all other requirements of this <br />title applicable to the use zone in which the receiving lot is located <br />(building height, off-street parking, setbacks, multiple-family <br />development standards, etc.), excluding maximum permitted density. <br />(C) Mixed-Use and Industrial Zones. The amount of development <br />transferred to the receiving lot shall not exceed that which can be <br />accommodated by allowing an increase of permitted height on the <br />receiving lot of not more than fifteen feet. All other requirements of the <br />use zone in which the receiving lot is located shall be applicable to the <br />transferred development. <br />d. All other requirements of this chapter shall apply to the subject property, including but <br />not limited to submittal of mitigation plans, monitoring reports, and assurance devices, <br />installation of fencing and signs, and recording of protective covenants. <br />19.37.060 PERMITTED AND ALLOWED USES AND ACTIVITIES <br />A. Uses permitted on lots containing or adjoining critical areas shall be the same as those permitted in <br />the use zone in which the lot is located. Each use shall be evaluated in accordance with the review <br />process required for the proposed use in the use zone in conjunction with the requirements of this <br />chapter and other city, state, and federal regulations. The permitted and allowed uses listed in this <br />section may not be exempted from other state or federal regulations or permit requirements and may <br />not degrade a critical area or ignore risk from natural hazards. Any damage to, or alteration of, a critical <br />area or an associated buffer of the activity shall be restored, rehabilitated, or mitigated at the expense <br />of the property owner. Soil stabilization and erosion control shall be completed immediately after <br />vegetation removal. Unless otherwise specified below, other restoration or rehabilitation shall be <br />completed within 60 days of the damage or alteration, unless otherwise approved by the planning <br />director. <br />B. The following uses/activities are permitted in critical areas and their buffers subject to the review <br />process listed in EMC Title 15: <br />1. Minor utility construction projects. The placement of a utility pole, street sign, anchor, vault, <br />or other small component of a utility facility that disturbs less than one hundred square feet of <br />critical area and buffer, provided such projects are constructed using best management <br />practices to avoid and minimize impacts to critical areas and buffers, subject to the following <br />conditions:
