41 laid down as over other streets in said city, and shall have the right at all times by general ordinance to regulate the speed of locomotives and trains within the limits of the franchise hereby granted and the maximum period of time for which locomotives, cars or trains shall be allowed to blockade travel along or across the streets embraced in this grant , and shall have such further control and police powers over such streets as the city charter and state laws may now or hereafter permit. Section 5: The city of Everett hereby reserves to itself and its grantees the right to carry all water mains, sewer mains, gas pipes, conduits and other public utilities underneath, and wires above any and all tracks herein authorized, and the right of access to any space occupied by such tracks within the limits of any such streets, and the right to open the ground beneath said tracks for all purposes of construction, maintenance, repair , alteration and inspection of any such public utilities, which right shall be exercised, however, so as to interfere as little as practicable with the use of said tracks, and so as to leave the right of way occupied thereby restored to as good a condition as prior to any exercise of such right. Section 6: The grantee by the acceptance of this franchise shall be taken to have agreed with the city of Everett that it will within ninety days after the date this ordinance becomes effective, commence the construction of the freight warehouse, plans and speci- fications for which have been filed with the city clerk, and that it will complete such warehouse according to such plans and speci- fications, within six months' f rom the time work i s thus commenced. Section 7: This ordinance shall riot take effect until after the applicant shall deposit with the city clerk a certified check in the sum of five hundred dollars (°$500) , payable to the city treasurer . The check so deposited shall be held for one year
