41 <br /> laid down as over other streets in said city, and shall have <br /> the right at all times by general ordinance to regulate the speed <br /> of locomotives and trains within the limits of the franchise hereby <br /> granted and the maximum period of time for which locomotives, cars <br /> or trains shall be allowed to blockade travel along or across the <br /> streets embraced in this grant , and shall have such further control <br /> and police powers over such streets as the city charter and state <br /> laws may now or hereafter permit. <br /> Section 5: The city of Everett hereby reserves to itself <br /> and its grantees the right to carry all water mains, sewer mains, <br /> gas pipes, conduits and other public utilities underneath, and wires <br /> above any and all tracks herein authorized, and the right of access <br /> to any space occupied by such tracks within the limits of any such <br /> streets, and the right to open the ground beneath said tracks for <br /> all purposes of construction, maintenance, repair , alteration and <br /> inspection of any such public utilities, which right shall be <br /> exercised, however, so as to interfere as little as practicable <br /> with the use of said tracks, and so as to leave the right of way <br /> occupied thereby restored to as good a condition as prior to any <br /> exercise of such right. <br /> Section 6: The grantee by the acceptance of this franchise <br /> shall be taken to have agreed with the city of Everett that it will <br /> within ninety days after the date this ordinance becomes effective, <br /> commence the construction of the freight warehouse, plans and speci- <br /> fications for which have been filed with the city clerk, and that <br /> it will complete such warehouse according to such plans and speci- <br /> fications, within six months' f rom the time work i s thus commenced. <br /> Section 7: This ordinance shall riot take effect until after <br /> the applicant shall deposit with the city clerk a certified <br /> check in the sum of five hundred dollars (°$500) , payable to the <br /> city treasurer . The check so deposited shall be held for one year <br />
