NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Public Use. The construction of a special events center will promote and <br /> enhance the public welfare by supporting community activities that require large spaces. <br /> The events center will support such activities as a variety of local and regional amateur <br /> and professional sporting events, concerts, family shows and other community <br /> entertainment such as skating, youth hockey, gymnastics, ice-capades, circuses, <br /> symposiums and reunions. These activities promote public recreation, as well as foster <br /> community and family ties. The events center will also promote commerce and <br /> economic development in the City of Everett and Snohomish County generally. The <br /> center will also support technical and merchandising trade shows as well as educational <br /> seminars and employee training. The center will also provide an opportunity for <br /> commercial trade events such as boat, recreational vehicles, and home shows which <br /> require a large exhibition space as well as an attractive location for people to gather. <br /> Section 2. Public Necessity. The taking or damaging of property and/or easements <br /> located within the City of Everett, legally described above and depicted in Exhibit 1 <br /> attached hereto and incorporated herein by this reference ("Property"), is necessary for <br /> development, construction, operation and maintenance of the special events center. The <br /> Public Facilities District has commissioned, and the City has reviewed, feasibility studies <br /> and a Supplemental Environmental Impact Statement on a number of sites and has <br /> determined through these studies that the Property is located at the site best suited for <br /> construction of the project. <br /> The site on which the Property sits best meets the requirements of the City's <br /> planning codes and Comprehensive Plan in that it is located in the Central Business <br /> District and has appropriate topography. Further, the site is within the "Core" area of the <br /> City as defined in the 1987 Everett Central City Development Plan, where concentrated <br /> development is encouraged to locate. Large public assembly facilities should be located <br /> in the central business district to support the vitality of the City's businesses. The <br /> location also has the best urban street grid for traffic flow and is best for available <br /> parking. The sloping topography supports entries at two different levels which is <br /> important for maintaining separate entrances for the main event's floorshow and the <br /> concourse. The subsurface geology is capable of supporting a heavy load which is <br /> important for public assembly events. <br /> Section 3. Condemned Property. The City has unsuccessfully attempted to negotiate <br /> and close the purchase of the Property legally described in Exhibit 1 from the owners <br /> thereof. In view of the impasse reached with the property owners, the City Council of the <br /> City of Everett, after reviewing the planned construction, hereby declares that the <br /> Property (Exhibit 1), shall be and hereby are condemned, appropriated, taken and/or <br /> damaged for the public use and purpose of constructing a special events center as <br /> described in section 1 above. The condemnation, appropriation, taking and/or damaging <br /> of the Property includes the right to make all necessary slopes for cuts and fills upon <br /> adjacent lands, as well as temporary easements to enable construction.
