Claims, in the PRA Lawsuit with prejudice; a dismissal of the pending appeal, and each <br /> party responsible for its own costs. It shall be the obligation of the City of Everett to file <br /> the Stipulated Order of Dismissal, but such order shall not be entered until Counsel for <br /> Defendant has received payment. <br /> 3. Payment to Defendant. As consideration for its release hereunder,the City agrees <br /> to pay to the Defendant the sum of Twenty-Five Thousand Dollars and Zero Cents ($25,000.00) <br /> to be mailed by June 19,2026. The check for payment shall be made payable to the Trust Account <br /> of Hall and Gilliland PLLC mailed to 1111 West Yakima Ave, Yakima,WA 98902. <br /> 4. Authority. The undersigned have full authority to enter into this Agreement. <br /> 5. Voluntary Act. This Agreement is made and entered into as a free and voluntary <br /> act and Defendant admits he has had consulted with his attorney, Timothy Hall, to obtain legal <br /> advice before entering into this agreement. <br /> 6. No Admission. The parties agree that the City's agreement to settle and payment <br /> do not constitute any admission of liability on the part of the City or its employees. <br /> 7. No Modification. This Agreement may not be altered, modified, or amended <br /> without the express written consent of the party or parties to be bound thereby. <br /> 8. Photocopies Effective As Original. The executing parties agree that a photocopy <br /> or other signed copy of this Agreement is as effective as the original and that email transmission <br /> of the same will be binding upon the parties. <br /> 9. Parties Bound: The City and Defendant agree that this Settlement Agreement will <br /> be binding upon them, their marital communities (whether or not their spouses are specifically <br /> named), their officers, directors, shareholders, attorneys, agents, parents, subsidiaries, related <br /> entities, affiliates, respective heirs, insurers, executors, administrators, legal representatives, <br /> successors and assigns. <br /> (Agreement continues on next page) <br /> RoDRIGUEz/CUE SETTLEMENT AGREEMENT-2 of 3 <br />
