p . <br /> northeast corner of Hoyt Avenue 231.60; at the southeast corner of <br /> Hoyt Avenue 232.40; at the northwest corner of ,Hoyt Avenue 230.70; <br /> at the southwest corner of Hoyt Avenue 231.50; at the east line of <br /> Rucker Avenue 208.54. <br /> Section 3; Said grades shall run a uniform grade line between <br /> said described points on said Hoyt Avenue and Wall Street, and are <br /> the curb levels of said grades of said streets and avenues above <br /> the datum plane of the city of Everett as established by Ordinance <br /> No. 101. <br /> Section 4: That all the lands , premises and other property <br /> or property-rights necessary to be taken, used or damaged in grad- <br /> ing and regrading of said Hoyt Avenue and Wall Street, and approach- <br /> es thereto in conformity with such established grade, and. in the <br /> construction of viaducts , slopes and retaining walls for cuts and <br /> fills upon the property abutting on said street, and approaches <br /> thereto ,' be, and the same hereby are condemned and appropriated to <br /> the public use for said, purpose. Such lands, rights and premises are <br /> to be taken, damaged and appropriated only after just compensation <br /> has been made or paid into court for the owner or other persons <br /> entitled thereto in the manner provided by law. <br /> Section 5; That the city attorney be, and he is hereby author- <br /> , ized and directed to file in the superior court in the name of the <br /> city of Everett a petition complying with the requirements and laws <br /> of the state of Washington., and praying that just compensation to be <br /> made for the land and other property-rights to be taken or damaged <br /> by the establishing and changing of said grades of said Hoyt Avenue <br /> and Wall Street, as provided herin, be ascertained by a jury, or <br /> by the court in case a jury be waived. <br /> Section 6: An assessment shall be made and levied in the manner <br /> provided by law for the purpose of raising the amount necessary. to <br /> pay the compensation and damages which shall be .obtained for <br /> the property taken or damaged as aforesaid, together with <br /> the cost of the proceedings to be had therein, including also <br />
