C AL_L <br /> ORDINANCE NO./40 <br /> YT <br /> An Ordinance, providing: for terminating the lease of the City <br /> dock property heretofore made to Coleman & Fogarty and now held by <br /> the City Dock Company, a corporation, for the purchase and taking <br /> over of all the improvements placed on said property by said company <br /> or their assignors , for the construction of an extension of the wharf <br /> together with additional buildings thereon,, for the issuance of spec- <br /> ial negotiable bonds to raise revenue with which to take over and <br /> pay for said improvements and said new construction together with all <br /> necessary engineering expense, creating a City Dock fund, authorizing <br /> the service cif the necessary notice on the lessees of said property, <br /> • and submitting said ordinance to the qualified voters of said city <br /> of Everett for ratification or rejection at a municipal election to <br /> be held June 18th, A. D. 1912. <br /> THE CITY OF .EVERETT DOES ORDAIN: <br /> Section 1. That it is the intention of the City of Everett, <br /> on the 10th day of August , 1912, to take over,. purchase and possess <br /> itself of all the improvements on certain real estate in said City , <br /> belonging to said City, and commonly known as the City Dock in ac- <br /> cordance with provisions of a certain lease cof said dock given by <br /> said City to Coleman & Fogarty, TrUs teen :. aand ,to terminate and cancel <br /> said lease. The Mayor of said City is hereby authorized and required <br /> to give to the said lesses or their assigns the necessary sixty days <br /> notice of said intention as provided in said lease and the Commissioner <br /> of Public Works , or his proper representative, is hereby authorized <br /> to take possession of said improvements and said property on August <br /> 10th, 1912, and thereafter to control and operate and maintain the <br /> same under the direction of the council of said city. <br /> Section 2. That on July 1st, 1912 , or immediately thereafter <br /> the Council of said City shall 'endeavor to come to a satisfactory <br /> agreement with the said lessees or their assigns as to the presen', - <br />
