FY270086 CITY OF EVERETT Page 6 of 17 <br />materials to any other person or organization for any purpose without the express written authorization of the <br />Recipient. <br />Materials provided by OPD to the Recipient remain the sole property of OPD and cannot be used by the Recipient for <br />purposes beyond this Contract without the express written authorization of OPD. <br />13. RESPONSIBILITY OF THE PARTIES <br />Each party to this Contract assumes responsibility for claims and/or damages to persons and/or property resulting <br />from any act or omission on the part of itself, its employees, or its agents. Neither party assumes any responsibility <br />to the other party for any third-party claims. <br />14. ORDER OF PRECEDENCE <br />In the event of an inconsistency in this Contract, the inconsistency will be resolved by giving precedence in the <br />following order: <br /> <br />A. Applicable federal and state of Washington statutes and regulations. <br />B. Terms and Conditions as contained in this basic Contract instrument. <br />C. General Terms and Conditions. <br />D. Any other provision, term, or material incorporated herein by reference. <br /> <br />
