SECTION 5: REVIEW PROCESS IV: Board of Adjustment—Public Hearing for <br /> Variance <br /> A. Review Process IV. Review Process IV applies only to permit applications for <br /> variances from the provisions of the Zoning Code that do not require any Review Process <br /> II or III permit or Hearing Examiner decision, including: <br /> 1. Variance request <br /> 2. Variance for reduction in parking requirements by more than 10% if not <br /> considered concurrently with a Review Process III use (EMC 19.34.070A.2) <br /> 3. Modification of approved site plan <br /> 4. Appeal of a Planning Department denial of extension of a variance. <br /> B. Hearing. Review Process IV applications require an open public hearing before <br /> the Board of Adjustment. Public notice requirements are specified in Chapter 6 of this <br /> Ordinance. <br /> C. Review Criteria. Except as otherwise provided by this Ordinance, the Board of <br /> Adjustment shall review all requests for variances to the provisions of the Zoning Code. <br /> The criteria to be used for evaluating variance requests are specified in EMC 19.41.130C. <br /> D. Action Taken. Following an open public hearing before the Board of Adjustment, the <br /> Board shall render a final decision on a variance application, including a modification of <br /> approved site plan or an appeal of an extension request, in the form of a written order. <br /> 1. Granting of a Variance. The decision of the Board of Adjustment to grant a variance <br /> shall become effective as of the date set forth in the order. If the applicant does not obtain <br /> an appropriate permit within one (1) year from the effective date of the written order, the <br /> variance shall cease to be effective. <br /> 2. Conditions and Restrictions. The Board of Adjustment may require conditions and <br /> restrictions to assure that the granting of the variance is not detrimental to surrounding <br /> properties or public right-of-way. <br /> 3. Modification of Approved Site Plan. Any building, structure or use for which a <br /> variance has been granted shall be established in precise conformance with the <br /> site plan approved by the Board of Adjustment. No change in the location of the <br /> building, structure or use shall be permitted without approval by the Board of <br /> Adjustment . In considering any change to the approved plan, the same <br /> notification and public hearing procedures shall be followed as required for a new <br /> variance application. <br /> 4. Extension of a Variance. The Planning Department is authorized to grant a six- <br /> month extension of time to a variance, provided a written request is submitted <br /> 23 <br />
