SECTION 4: SPECIAL CIRCUMSTANCES A. Special Circumstances. The City has determined that the following permits present special circumstances that warrant a different review process than that provided in RCW 36.70B.060 et seq: 1. Review Process VA. Adoption of a"Planned Development"Overlay Zone or a rezone or other zoning revision that is not of area-wide significance or general applicability, or other quasi-judicial permit decisions, which provide for a public hearing or meeting before the Planning Commission and an open public hearing before the City Council. 2. Review Process VB. A decision on proposed demolition of a structure listed in the "Everett Register of Historic Places"or property within an Everett Register historic district only which provides for a public hearing or meeting before the Historic Commission and an open public hearing before the City Council. 3. Review Process VI. A decision by City Council to approve a final subdivision, final cluster subdivision, alteration or vacation of a final subdivision, and a final approval of resolution of intent to rezone. CHAPTER 2: DEFINITIONS AND USAGE SECTION 1: DEFINITIONS FOR PURPOSES OF THIS ORDINANCE A. "Applicant"means the person or entity proposing a project. Applicant includes private or public entities. The Applicant shall be the owner of land or authorized representative. Applicant includes the entity or person for which an authorized representative is submitting an application. B. "Application"means a written request to the City to issue a land use permit. Unless the context clearly requires otherwise, "application"refers to a"complete application." C. "City"means City of Everett. D. "City Council"means the office of City Council whenever reference is made in this Ordinance to the transmittal of recommendations, requests, or other submittals to the City Council. E. "Code" or"EMC"means the Everett Municipal Code. 3
