laws for a period of five (5) years from date of filing, unless the City Council <br /> finds that a change in conditions in the subdivision creates a serious threat to the <br /> public health or safety. <br /> D. Resubdivision Restrictions for Short Subdivisions <br /> 1. Five Year Restriction. Land within an approved short subdivision shall not be <br /> resubdivided for a period of five (5) years from the date of final approval of the <br /> short subdivision without the submission and approval of a final subdivision <br /> under all provisions of this Ordinance concerning the subdivision of land into ten <br /> or more lots, tracts or parcels. <br /> 2. Nine Lot Restriction. When the original short subdivision contains nine (9) or <br /> less lots, the above restrictions shall not apply to the creation of additional lots, <br /> not exceeding a total of nine (9). If the number exceeds nine (9), a new <br /> application must be filed and processed. After five (5) years, further division may <br /> be permitted when otherwise consistent with the regulations of the City. <br /> 3. Withdrawal of Application. Where there have been no dedications to the public <br /> and no sales of any lots in a short subdivision, nothing contained in this section <br /> shall prohibit an applicant from completely withdrawing his entire short <br /> subdivision application and thereafter presenting a new application. <br /> SECTION 6: PLANNED ACTION PROJECT REVIEW <br /> A. Planned Action Review Process. The review process for a project that is <br /> proposed as a planned action shall be determined by the permits required for the planned <br /> action. Because an environmental impact statement will previously have been prepared, <br /> review of a project proposed as a planned action is intended to be simpler and more <br /> focused than for other projects. A planned action includes a type of project action, or a <br /> subsequent project that implements an adopted subarea plan, master planned <br /> development, or phased project, that is designed by ordinance or resolution as a planned <br /> action and meets the criteria in RCW 43.21C.031(2)(a). <br /> B. Verification. A project proposed as a planned action shall be reviewed for <br /> consistency with the comprehensive plan and adopted planned action ordinance and for <br /> compliance with applicable development regulations and City ordinances. <br /> To determine whether a proposed action qualifies as a planned action,planned action <br /> project review shall include: <br /> 1. Verification that the project meets the description in, and will implement any <br /> applicable conditions or mitigation measures identified in, the designating <br /> ordinance or resolution; and <br /> 44 <br />
