C. SEPA Statement. The notice of decision shall include a statement of any SEPA <br /> threshold determination and the procedures for any administrative appeal. The notice of <br /> decision maybe a copy of the report or decision on the project permit application. <br /> D. Recipient of Notice. The notice shall be provided to the applicant and to any <br /> person who, prior to the rendering of the decision, made a written request for a notice of <br /> the decision or submitted substantive comments on the application. <br /> E. Shoreline Permits. A notice of decision for a Review Process II or III shoreline <br /> substantial development, variance, and/or conditional use permit shall also be provided to <br /> the Washington State Department of Ecology and the Attorney General's Office. The <br /> notice of decision sent to the Department of Ecology and the Attorney General's Office <br /> shall comply with the requirements of WAC 173-27-130 and shall include: <br /> 1. A copy of the complete application; <br /> 2. Findings and conclusions that establish the basis for the decision including but not <br /> limited to identification of shoreline environment designation, applicable master <br /> program policies and regulations, and the consistency of the project with <br /> appropriate review criteria for the type of permit(s) as established in WAC 173- <br /> 27-140 through 173-27-170; <br /> 3. The final decision; <br /> 4. The permit data sheet required by WAC 173-27-990; <br /> 5. The applicable SEPA documents or a statement summarizing the SEPA <br /> determinations; and <br /> 6. When the project has been modified in the course of the local project review <br /> process, plans or text shall be provided that clearly indicate the final approved <br /> plan. <br /> F. Shoreline Conditional Uses and Variances—Final Decision. After taking <br /> actions on a substantial development permit designated to be a conditional use or <br /> variance in the master program, the City shall submit the permit to the Department of <br /> Ecology for final action. For shoreline variance and conditional use permits, the <br /> Department of Ecology issues the final decision. The Department of Ecology shall <br /> render and so notify the City and the applicant of its final decision approving or <br /> disapproving the permit within thirty days of filing by the City. The City shall notify <br /> those interested persons having contacted local government under the final decision. <br /> G. Examiner Decision as Notice. For Review Process IIIA, the notice of decision <br /> shall be the written decision of the Hearing Examiner. <br /> H. Time Limits not Met. If the City is unable to issue its final decision on a project <br /> permit application within the time limits provided for in this section, it shall provide <br /> written notice of this fact to the project applicant.
