Review Process VI, City Council Decision. <br /> The decision of the City Council is final. All appeals shall be to Snohomish <br /> County Superior Court in accordance with Chapter 36.70C, RCW and shall be <br /> filed within twenty-one (21) days of issuance of the decision. <br /> E. Consolidated Administrative Appeals <br /> 1. Any appeal of Review Process I or II permits and any appeal of environmental <br /> determinations on these permits (other than an appeal of a SEPA determination of <br /> significance) shall be considered together in a single consolidated open record <br /> appeal hearing before the Hearing Examiner. The Examiner's decision on the <br /> appeal shall be final. <br /> 2. Any appeal of a SEPA determination, other than a SEPA determination of <br /> significance for a Review Process III decision shall be considered in a single <br /> hearing before the Examiner. The Examiner shall consolidate the open public <br /> hearing on the permit with the open record appeal hearing on the SEPA <br /> determination. <br /> 3. The Examiner's decision on both the SEPA appeal and a Review Process IIIA <br /> permit shall be final. The Examiner's decision on a SEPA procedural appeal <br /> shall be final and shall accompany the Examiner's recommendation on a Review <br /> Type IIIB permit to the City Council. <br /> 4. The time period for the Examiner to issue a recommendation or render decision <br /> under Review Process III shall be extended as necessary for the Examiner to hear <br /> and render a decision on the appeal, subject to the ninety(90) limit to issue an <br /> appeal decision. <br /> 5. Exceptions: <br /> a. A subsequent proceeding shall be allowed on the adequacy of an EIS and <br /> associated permit; and <br /> b. A separate open record appeal hearing shall be allowed on a SEPA <br /> determination of significance prior to further processing of the land use permit or <br /> issuance of a decision. <br /> c. A separate open record appeal hearing on a SEPA procedural <br /> determination (threshold determination or EIS adequacy) shall be provided on <br /> City proposed actions other than those requiring City Council legislative <br /> 72 <br />
