C. For purposes of this Ordinance, the term "consistency" shall include but not be <br /> limited to the terms compliance, conformity, and consistency to refer to performance in <br /> accordance with this Ordinance and RCW 36.70A. <br /> D. Nothing in this section requires documentation, dictates procedures for <br /> considering consistency, or limits the Director from asking more specific or related <br /> questions with respect to any of the four main categories listed in subsection A of the <br /> project consistency section of this Ordinance. This Ordinance does not apply to the <br /> City's Civil Enforcement Procedures, EMC 1.20, except as specifically referenced herein. <br /> SECTION 3: DOCKETING <br /> In accordance with RCW 36.70A.470, any interested person, including applicants, <br /> citizens, hearing examiners, City officials, and staff of other agencies, may suggest plan <br /> or development regulation amendments in writing to the Director,which shall be <br /> docketed and considered on at least an annual basis, consistent with the provisions of <br /> RCW 37.70A.130. <br /> CHAPTER 4: PROCEDURES FOR TYPES OF LAND USE DECISIONS <br /> SECTION 1: TYPES OF LAND USE PERMIT APPLICATIONS <br /> A. Land Use Permit Processes. For the purpose of project review, all land use <br /> permit applications shall be classified as one of the following: <br /> • Review Process I, Minor Administrative Review Decisions; <br /> • Review Process II, Planning Director Administrative Review Decisions; <br /> • Review Process IIIA, Hearing Examiner Decisions; <br /> • Review Process IIIB, Hearing Examiner and City Council Quasi-Judicial <br /> Decisions; <br /> • Review Process IV, Board of Adjustment Zoning Variance Decisions; <br /> • Review Process VA, Planning Commission and City Council Land Use <br /> Quasi-Judicial Decisions; <br /> • Review Process VB, Historic Commission and City Council Land Use Quasi- <br /> Judicial Decisions; and, <br /> • Review Process VI, City Council Approval of Final Subdivisions (plats) and <br /> Final Approval of Performance Agreement Rezones. <br /> B. Legislative Decisions. Legislative decisions are not subject to the permit process <br /> procedures of this Ordinance. In order to promote a public understanding of <br /> governmental actions relating to land use and the environment, certain legislative <br /> decisions are included in and governed by Chapter 8 of this Ordinance. Specifically, <br /> public notice requirements for certain legislative decisions made by the City Council that <br /> relate to land use and the environment are also set forth in this Ordinance. <br /> 8 <br />
