C. Grantor shall install the following improvements: <br /> 1. Striped crosswalk to the ramp area in location "2" on Map. <br /> 2. Access gate in location "4" on Map. <br /> 3. The following signage shall be posted at locations 1 through 4 <br /> on Map: <br /> • "Hours: Open Dawn to Dusk Only" <br /> • "Straying Off-Trail is Trespassing" <br /> • "Pedestrians Must Yield to Traffic" <br /> • "Path Dead Ends Ahead; Dismount Bicycles" <br /> • "Use at Your Own Risk—Active Marine Industrial <br /> Zone" <br /> 3. Use; Reservation. It is mutually agreed and understood that the Interim <br /> Easement is conveyed solely for the purposes set forth above, and Grantor reserves all <br /> rights to reasonably use the Interim Trail area that are not inconsistent with the intent of <br /> the Interim Easement, including the ability to temporarily suspend use of the Interim Trail <br /> area for any purposes associated with the Property's active marine and industrial <br /> operations. Such reserved rights include, but are not limited to, utilizing the trail area for <br /> commercial vehicles and heavy machinery (including travel lifts and marine forklifts) and <br /> to temporarily suspend pedestrian access to ensure public safety during active vessel <br /> handling. <br /> 4. Statutory Immunity and Assumption of Risk. The parties acknowledge and <br /> agree that Grantor is granting this Interim Easement for outdoor recreational purposes <br /> without charging a fee of any kind. Accordingly, Grantor expressly invokes, and intends to <br /> be afforded the full protections of, Washington's Recreational Use Immunity statute <br /> (RCW 4.24.210), as amended. The intent of the City and the Grantor is that the public's <br /> use of the Interim Trail is at their own risk. Neither Grantor nor the City shall be liable for <br /> any unintentional injuries, including but not limited to slips, trips, and falls, sustained by <br /> any member of the public utilizing the Interim Trail. Furthermore,the presence of active <br /> marine industrial operations adjacent to the Interim Trail constitutes a known, visible <br /> environment, and pedestrians assume all inherent risks associated with transiting near <br /> such operations. <br /> Interim Public Access Trail Easement Page 3 <br />
