E. Notification. Notification for special property use applications shall be provided <br /> according to the required review process, specified as follows: <br /> 1. Review Process II.B. Written notice of the planning director's decision shall be mailed <br /> to the owners of all property within five hundred feet of the subject property. <br /> 2. Review Process III.B. Written notice shall be mailed to all owners of property located <br /> within five hundred feet of the site boundaries at least ten days prior to the date of the <br /> public hearing, and notice of the hearing shall be published at least ten days prior to the <br /> date of hearing. Notice shall also be posted in two conspicuous locations on or near the <br /> site at least ten days prior to the public hearing. <br /> 3. Review Process V.B. Written notice shall be mailed to all owners of property located <br /> within five hundred feet of the site boundaries at least ten days prior to the date of public <br /> hearing, and notice of the hearing shall be published at least ten days prior to the date of <br /> public hearing. Notice shall also be posted in two conspicuous locations on or near the <br /> site at least ten days prior to the public hearing. <br /> F. Review Authority Decisions. <br /> 1. Conditions and Restrictions. If the review authority approves a special property use <br /> permit, conditions and restrictions may be applied thereto, which exceed the minimum <br /> standards required by this title, when necessary to assure that the proposed use complies <br /> with all requirements of this title and is compatible with surrounding land uses. <br /> 2. Time Limit on Approval. The effective time period in which the applicant may <br /> establish the use proposed by an approved special property use permit shall be five years <br /> from the date of the written order granting approval of the permit. The written order may <br /> specify a shorter time period if the review authority determines that it is in the public <br /> interest to authorize a shorter period of time in which to establish the use. The planning <br /> department may authorize one extension of time for a period of not more than one year if <br /> it can be found that circumstances beyond the control of the applicant prevented the <br /> establishment of the use. <br /> 3. Appeal Period. The action of the review authority on granting or denying a special <br /> property use permit shall be final unless the following action occurs for the respective <br /> review process used in deciding upon the special property use: <br /> a. Review Process II.B. Within ten days of the effective date of the planning director's <br /> written order, an appeal is filed with the planning department. Such an appeal shall be <br /> heard by the hearing examiner using Review Process III.A. <br /> b. Review Process III.B. Appeal procedures for special property uses which were <br /> considered under Review Process III.B shall be as established by the hearing examiner <br /> ordinance. <br /> c. Review Process V.B. Within ten days of the date of the planning commission's written <br /> order, an appeal is filed with the planning department. Such appeals shall be heard by the <br /> city council. Only the applicant or a person who has actively participated in the hearing <br /> before the planning commission may file an appeal. Appeals shall be filed on forms <br /> provided by the planning department and shall be accompanied by the filing fee <br /> established by ordinance. <br /> BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: <br /> Special property uses. <br /> 24 <br />
