a. Review Process II. The Planning Director's Review Process II Determination may be <br /> appealed as provided by the City's Local Project Review Procedures Ordinance. <br /> b. Review Process III. No administrative appeal is provided for Review Process III <br /> decisions. <br /> SECTION 16: That Chapter 41 of Ordinance No. 1671-89 as amended by Section 65 of <br /> Ordinance No. 1849-92, Section 1 of Ordinance No. 2012-94 and Section 6 of Ordinance <br /> No. 2384-99 (EMC 19.41.160)which reads in part as follows: <br /> Rezones. <br /> A. User Guide. This subsection establishes the mechanism and criteria for the city to <br /> change a zoning classification on the zoning map and to change the boundaries of zones <br /> on the zoning map. This mechanism is called rezoning. Please note that this section does <br /> not apply to proposals to amend the text of this title. Section 41.170describes how that <br /> can be done. <br /> B. Types of Rezones. There are two types of rezones: <br /> 1. Area-wide Rezones. A rezone shall be treated as an area-wide rezone when: <br /> a. It is initiated by the city; or <br /> b. A significant class of properties are similarly affected by the proposed rezone; and <br /> c. It is either: <br /> (1) Based upon an adopted or ongoing comprehensive planning process; or <br /> (2) Part of a process that includes amending the text of this title. <br /> 2. Site-specific Rezones. A rezone will be treated as a site-specific rezone when it does <br /> not meet the requirements of subdivision I of this subsection. <br /> 3. Notification. Notification for rezones shall be provided as specified herein: <br /> a. Site-specific rezones: Written notice shall be mailed to all owners of property located <br /> within five hundred feet of the site boundaries at least ten days prior to the date of public <br /> hearing, and notice of the hearing shall be published at least ten days prior to the date of <br /> hearing. Notice shall also be posted in two conspicuous locations on or near the site at <br /> least ten days prior to the public hearing. <br /> b. Area-wide rezones: Except as provided in subsection c. of this section, written notice <br /> shall be mailed to all owners of property located within five hundred feet of the site <br /> boundaries at least ten days prior to the date of public hearing, and notice of the hearing <br /> shall be published at least ten days prior to the date of hearing. Notice shall also be posted <br /> in two conspicuous locations on or near the site at least ten days prior to the public <br /> hearing. <br /> c. Area-wide rezones required to ensure compliance with the Growth Management Act: <br /> When area-wide rezones are required in order for the city to implement the requirements <br /> of the Growth Management Act in adopting or updating the comprehensive plan, written <br /> notice shall be mailed to owners of all properties proposed to be rezoned at least ten days <br /> prior to the date of hearing. The city shall also publish notice of the proposed rezone at <br /> least ten days prior to the date of hearing. This subsection, subsection c of Section <br /> 41.160.B.3, shall expire on December 31, 1994. After December 31, 1994, the notice <br /> provisions in subsection b of Section 41.160.B.3 shall apply to area-wide rezones. <br /> C. Area-wide Rezones. <br /> 30 <br />
