B. Applicable Process. The City will use the review process as described in the City's <br /> Local Project Review Procedures Ordinance to review and decide upon a proposal to <br /> amend the text of this title. <br /> C. Criteria for Amending the Text of the Zoning Code. The City may amend the text of <br /> this title only if it finds that: <br /> 1. The proposed amendment is consistent with the applicable provisions of the Everett <br /> general plan; and <br /> 2. The proposed amendment bears a substantial relation to public health, safety or <br /> welfare; and <br /> 3. The proposed amendment promotes the best long term interests of the Everett <br /> community. <br /> D. Notification. Notice of the proposed action shall be provided in accordance with the <br /> City's Local Project Review Procedures Ordinance. <br /> E. Who May Initiate Proposed Amendments. Proposed amendments may be initiated by <br /> the Planning Commission, Mayor or City Council. <br /> SECTION 18: That Chapter 41 of Ordinance No. 1671-89 as amended by Section 30 of <br /> Ordinance No. 1729-90, Section 6 of Ordinance No. 1864-92, and Sections 14 and 15 of <br /> Ordinance No. 2144-96 (EMC 19.41.180)which reads in part as follows: <br /> Appeals. <br /> A. Appeals - General. Appeals related to certain specific types of permits are provided <br /> for in this title in the sections describing each type of permit. Where appeals procedures <br /> are not specifically listed in this title for a particular permit procedure or decision-making <br /> process, the provisions of this section shall apply. <br /> B. Appeals - Unlisted Uses. Subsection 2.080D of this title provides a specific method <br /> for determining whether an unlisted use is permitted in a specific zone. Appeals of a <br /> determination concerning whether or not an unlisted use shall be permitted within a <br /> specific zone shall be made to the planning commission, who shall review the appeal <br /> using Review Process V.A. In reviewing such an appeal, the planning commission may <br /> take action as it determines to be appropriate, based upon the nature of the unlisted use <br /> and the evaluation criteria listed in subsection 2.080D. The action of the planning <br /> commission shall constitute a recommendation which shall then be considered by the city <br /> council, at which time the city council shall make a determination whether the unlisted <br /> use is permitted or not permitted. <br /> C. Appeals -Application of Development Standards. <br /> 1. Non-Adult Use Businesses. Certain review procedures and decision-making processes <br /> described in this title require the planning department or planning director to use <br /> discretion in the application of development standards to a particular use or development. <br /> Any person who feels that the application of development standards to a particular use or <br /> development has been improper or inappropriate may file an appeal. Unless otherwise <br /> specified in this title, such appeals shall be reviewed by the hearing examiner using <br /> Review Process IIIA described in Chapter 42 of this title. In evaluating such an appeal, <br /> the hearing examiner shall consider the following criteria: <br /> a. The nature of the use or proposed use of the subject property; <br /> b. The purpose for the particular development standard which is being appealed; <br /> 38 <br />
