8 <br /> FIRST AMENDMENT TO <br /> PARKING MANAGEMENT AGREEMENT <br /> This FIRST AMENDMENT TO PARKING MANAGEMENT AGREEMENT is made this <br /> 29TH day of June, 2016, by and between the City of Everett, a municipal corporation under laws <br /> of the State of Washington (herein after referred to as "City"), and the Downtown Everett <br /> Association (hereinafter referred to as the "Manager"), a Washington nonprofit corporation. <br /> RECITALS <br /> A. City and Manager are parties to that certain Parking Management Agreement for <br /> the day-to-day operation of Everpark Parking Facility dated July 1, 2013, (the "Agreement"), a • <br /> 500-car parking facility located in the 2800 block of Hoyt Avenue, Everett, Washington. <br /> D. City and Manager now wish to amend the Agreement to extend the term of the <br /> Agreement for an additional six months subject to and in accordance with the following terms <br /> and conditions. <br /> AGREEMENTS <br /> In consideration of the mutual covenants and agreements herein contained, and other <br /> good and valuable consideration, the receipt and sufficiency of which are hereby mutually <br /> acknowledged, the parties do hereby amend the Agreement as follows: <br /> That section of the Agreement which currently reads: <br /> 1. TERM <br /> The Manager shall provide services, work, improvements and equipment pursuant to <br /> this Agreement for a period of three years, commencing on July 1, 2013, and ending June 30, <br /> 2016. <br /> Is hereby amended to read as follows: <br /> 1. TERM <br /> The Manager shall provide services, work, improvements and equipment pursuant to <br /> this Agreement for the period commencing on July 1, 2013, and ending December 31, 2016. <br /> No Further Amendment. Except as expressly modified by this Amendment, all terms, <br /> covenants and provisions of the Agreement shall remain unmodified and in full force and effect <br /> and are hereby expressly ratified and confirmed. <br /> 1 <br /> 76 <br />
