ORDINANCE NO. 2536-01 An Ordinance amending the land division regulations to be consistent with the provisions of the City's Local Project Review Procedures Ordinance, superseding and amending Ordinance No. 2328-98 as amended (Title 18 EMC) WHEREAS, the City adopted interim permit review processes for land use permits through the adoption of Ordinance No. 2136-96; and WHEREAS, through the adoption of the City's Local Project Review Procedures Ordinance, the City has incorporated the interim regulations into the Local Project Review Procedures Ordinance which is intended to be a master procedural ordinance for land use applications within the City; and WHEREAS, consistent with the intent of the master procedural ordinance, the procedural aspects from the City's land division regulations (Title 18 EMC) have been incorporated into the Local Project Review Procedures Ordinance; and WHEREAS, it is the intent of this ordinance to make the necessary revisions to the City's land division regulations so that those provisions that have been incorporated into the Local Project Review Procedures Ordinance are removed from the City's land division regulations; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: SECTION 1: That Section 1E(1) of Ordinance No. 2328-98 (EMC 18.04.050) which reads as follows: EMC 18.04.050 Divisions of land- Compliance required. Every division, redivision, alteration or vacation of land into lots, tracts, parcels, sites or divisions for the purpose of sale, lease or transfer of ownership shall proceed in compliance with the provisions of state law and this title. All contiguous parcels of land under common ownership, regardless of date of acquisition or location in different lots, tracts, parcels, sites, tax lots or separate government lots that are subject to a division of land shall constitute a single application. Multiple applications or applications and/or exemptions shall not be utilized as a substitute for a comprehensive development approach in accordance with the requirements of Title 15 of this code, as amended, and this title.
