reviewing such a proposal, the planning director shall not approve the proposed building <br /> appurtenance if it would significantly obstruct views from and solar access for <br /> surrounding properties. <br /> SECTION 68: That Ordinance No. 1671-89 as amended by Section 49 of Ordinance <br /> No. 1849-92 (EMC 19.39.070 A) which reads in part as follows: <br /> A. Height. <br /> 1. Except as provided in subsection A.2 of this section, fences in residential zones <br /> and fences located on the common abutting property line in nonresidential zones which <br /> immediately abut residential zones shall not exceed six feet in height. Within the front <br /> yard setback areas, the maximum height shall not exceed forty-two inches, unless <br /> approved by the planning director using Review Process II.A. <br /> 2. Fences on residentially zoned lots abutting freeways shall be permitted a height of <br /> ten feet when located and constructed to reduce the impacts of freeway noise on the <br /> residential lot. When the use of the property requires compliance with the landscaping <br /> requirements of Section 35.090, the fence shall be set back the distance required to <br /> accommodate the landscaping, and provision shall be made for access to the landscape <br /> area for maintenance purposes. <br /> 3. Fences in commercial and industrial zones shall not exceed ten feet in height, <br /> including barbed wire located on top of the fence. <br /> 4. Fences in residential zones may exceed six feet in height provided that they meet <br /> the building setback requirements and do not exceed the building height requirements of <br /> the zone in which they are located. <br /> BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: <br /> A. Height. <br /> 1.
