a. The rockery or retaining wall is not being used as a direct structural support for a <br /> building; <br /> b. The rockery or retaining wall is reasonably necessary to provide support to a cut <br /> or slope; <br /> c. The rockery or retaining wall will not obstruct or interfere with the vision of <br /> vehicles and pedestrians using driveways and public rights-of-way; and <br /> d. Any structure retaining soil which is greater than thirty-six inches in height shall <br /> comply with building setback requirements, unless otherwise approved by the planning <br /> director, using Review Process IIA. <br /> BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: <br /> 5. Rockeries and retaining walls may be located in required setback areas if: <br /> a. The rockery or retaining wall is not being used as a direct structural support for a <br /> building; <br /> b. Any structure retaining soil which is greater than thirty-six inches in height shall <br /> comply with building setback requirements, unless otherwise approved by the planning <br /> director, using the review process described in the City's Local Project Review <br /> Procedures Ordinance. <br /> SECTION 72: That Ordinance No. 1671-89 as amended by Section 3 of Ordinance No. <br /> 1847-92 as amended by Section 1 of Ordinance No. 1864-92, Sections 1 &2 of <br /> Ordinance No. 1978-93, Section 1 of Ordinance No. 2076-95, Section 1(A) of Ordinance <br /> No. 2106-95, Section 2(A) of Ordinance No. 2111-95, Section 1 of Ordinance No. 2290- <br /> 98 and Sections 12-34 of Ordinance No. 2397-99 (EMC 19.04.020) is hereby amended <br /> by the addition of a new definition: <br /> "Should"means encouraged but not required. <br /> SECTION 73: Ordinance No. 1671-89 as amended by Section 36 of Ordinance No. <br /> 2397-99 and Section 2 of Ordinance No. 2445-00 (EMC 19.05, Use Standards Table 5.2) <br /> is hereby amended by the addition of a new use to the Special Property Use section of the <br /> Use Standards Table, Table 5.2 as follows: <br /> Special Aviation Use in M-M, M-1 and M-2 zones as "VA" <br /> SECTION 74: That Ordinance No. 1671-89 (EMC 19.33.030) which reads as follows: <br /> Designation—Who may apply. The proposal to include a specific area or property within <br /> the historic overlay zone may be initiated by the city or by an owner of property located <br /> within the proposed historic overlay zone.
