skateboard or similar device is accompanied by a person, shall be sufficient to establish <br /> probable cause of a violation of Section 2 of this ordinance. <br /> Section 5: Section 6 of Ordinance No. 1934-93, (EMC 46.72.040), which reads as <br /> follows: <br /> Skateboards—Riding on sidewalks. <br /> A. Whenever any person is riding a skateboard upon a sidewalk, such person shall yield <br /> the right-of-way to any pedestrian. <br /> B. No person shall ride a skateboard upon a public sidewalk or roadway in a business <br /> district. <br /> C. Violation of any provision of this section is a traffic infraction. <br /> D. "Business district," as used in this section, means any area designated by the Everett <br /> Zoning Code (EMC Title 19), as now or hereafter amended, as Zone B-1, B-2 (A), B-2 <br /> (B), C-1, or C-2. <br /> is hereby amended to read as follows: <br /> Skateboards—Riding on sidewalks. <br /> A. Whenever any person is operating or riding roller skates, in-line skates, a skateboard, <br /> coaster, toy vehicle or any device similar to the foregoing upon a sidewalk, such person <br /> shall yield the right-of-way to any pedestrian. <br /> B. No person shall operate or ride roller skates, in-line skates, a skateboard, coaster, toy <br /> vehicle or any device similar to the foregoing upon a public sidewalk or roadway in a <br /> business district. <br /> C. Violation of any provision of this section is a traffic infraction. <br /> D. "Business district," as used in this section, means any area designated by the Everett <br /> Zoning Code (EMC Title 19), as now or hereafter amended, as Zone B-1, B-2 (A), B-2 <br /> (B), C-1, or C-2. <br /> Section 6: Severability. <br /> Should any section, subsection, paragraph, sentence, clause or phrase of this ordinance or <br /> its application to any person or situation be declared unconstitutional or invalid for any <br /> reason, such decision shall not affect the validity of the remaining portions of this <br /> ordinance or its application to any other person or situation. The City Council of the City <br /> of Everett hereby declares that it would have adopted this ordinance and each section, <br /> subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one <br /> or more sections, subsections, clauses, phrases or portions be declared invalid or <br /> unconstitutional. <br /> 4 <br />
