1. Main Road Extension Obligations. <br /> A. Main Road Extension. Except as provided in Section 1.B below, the PDA <br /> is hereby amended so that the City is not responsible for the design and construction of the Main <br /> Road Extension and related improvements and the Stuchell and Newland access. The City has <br /> no further obligations for any such work. This includes, for example, Mill Site Owner <br /> completing at no cost to the City all work described in Section 22(d) and Section 8 of the Third <br /> Amendment. To the extent that the PDA, Development Agreement or other City-Developer <br /> written agreement relating to the Riverfront does not specify the requirements for such work, the <br /> Main Road Extension shall comply with standard City requirements for utility and road <br /> infrastructure. <br /> B. Work Related to Main Road Extension Retained by City. The City shall <br /> complete at the City's cost certain work related to the Main Road Extension as follows: <br /> 1. Final Lift. The City shall complete the upper 1.5 inches of asphalt <br /> pavement on the Main Road Extension no later than 12 months after Mill Site Owner gives the <br /> City Public Works Director written notice that it requests installation of such asphalt pavement, <br /> except that, regardless of the date of such notice, the City has no obligation to call for bids for <br /> such work and start such work until after Mill Site Owner completes its construction of the Main <br /> Road Extension and related improvements and until after Mill Site Owner substantially <br /> completes site development on the Mill Site. Prior to City starting work on this final lift, Mill <br /> Site Owner shall be responsible for any repairs to the roadway cross section installed by Mill Site <br /> Owner to the extent such repairs have not been necessitated by the actions of the City or City's <br /> contractors, agents, lessees or invitees. <br /> 2. Water Connection Work. The City shall complete the water work <br /> described on Exhibit A no later than 12 months after Mill Site Owner gives the City notice that <br /> Mill Site Owner has completed construction of the Main Road Extension and related <br /> improvements. (For clarity, the parties acknowledge that Exhibit A is only one sheet. The <br /> notation on the sheet that it is 1 sheet of 2 sheets is in error.) <br /> 2. Public Amenity Obligations. <br /> A. Picnic Shelter and Trails. The following replaces Sections 4.A. (5), (6) <br /> and(7)of the Seventh Amendment: <br /> (5) Group Picnic Shelter and Access. The City at its own cost <br /> shall complete all work necessary to construct a group picnic shelter along <br /> the Riverfront Trail near the Simpson Pad as generally shown on page 41 <br /> of the Master Plan (the "Picnic Shelter Project"). The City shall procure <br /> at the City's cost all necessary permits and complete the final design for <br /> the Picnic Shelter Project. The City shall commence the Picnic Shelter <br /> Project no later than twelve (12) months after completion of the final <br /> design and receipt of all necessary permits, and the City shall complete the <br /> 2 <br />
