/1141P116/.......-4111 <br /> ORDINANCE NO. 2554-01 <br /> • <br /> AN ORDINANCE providing for the vacation of Sound <br /> Avenue lying North of Shore Avenue <br /> WHEREAS, the City Council of the City of Everett, did by Resolution No. 5056 duly <br /> adopt and fix the 11th day of July, 2001 at 8:30A.M., as the date of public hearing; and <br /> WHEREAS, due and legal notice of the time and place of said hearing and <br /> determination of said Resolution has been given by the City Clerk in the manner <br /> prescribed by law; and <br /> WHEREAS, at the time and place fixed for hearing, the issues were publicly presented; <br /> and <br /> WHEREAS, the City Council finds it would not vacate the right-of- way if a utility <br /> easement and a view corridor easement could not be retained; and <br /> WHEREAS, the petitioners applied for said right of way vacation prior to the City of <br /> Everett's adoption of Resolution No. 5083 amending the compensation requirements <br /> for right of way vacations; and <br /> WHEREAS, it now appears to the City Council of the City of Everett that the said right- <br /> of-way resolved to be vacated should be vacated pursuant to the terms and conditions <br /> of this ordinance; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: <br /> That the following described right-of-way: <br /> • <br /> All that portion of Sound Avenue right of way, as platted, and abutting Lot 16, Block 9, <br /> Plat of Shore Acres, according to the plat thereof, recorded in Volume 8 of Plats, Page <br /> 32, records of Snohomish County, Washington; described as follows: <br /> BEGINNING at the Northeast corner of Lot 1, Plat of Edgewater, <br /> according to the plat thereof, recorded in Volume 10 of Plats, Page 94, <br /> records of Snohomish County, Washington; THENCE, Northeasterly to <br /> the Northwest corner of said Lot 16, Block 9, Plat of Shore Acres; <br /> THENCE, South along the West line of said Lot 16, said line also being <br /> the East right of way line of said Sound Avenue, to the Southwest corner <br /> thereof; THENCE, Southwesterly along the Southwesterly projected South <br /> line of said Lot 16 to intersect the East line of said Lot 1, Plat of <br /> Edgewater, said line also being the West right of way line of said Sound <br />
