#41111110 - ORDINANCE NO. 2556-01 An Ordinance Amending the Zoning Code Regulations for Mini-Casinos, and Amending Ordinance No. 1671-89, as amended, (EMC 19.04.020 and Chapter 19.05 EMC) WHEREAS, the City did adopt Ordinance No.1671-89 establishing a new Zoning Code which became effective on January 13, 1990; and WHEREAS, on August 4, 1999, the City Council amended the Zoning Code to provide for the development of mini- casinos in the B-2, B-3, C-1, C-2 and M-2 zones, as well as establishing a definition of"mini-casino"; and WHEREAS, the Planning Commission held a public workshop and public hearing to gather public testimony and review the development standards and regulations related to mini-casinos; and WHEREAS, the Planning Commission has recommended that the City Council amend the definition of mini-casino, and also amend the Use Tables to allow for this type of use to develop within limited areas of the C-1 R zone; and WHEREAS, the City Council finds that the proposed revision to the zoning code regulations for mini-casinos is consistent with the applicable provisions of the Everett general plan, bears a substantial relation to public health, safety or welfare and promotes the best long-term interests of the Everett community; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1. Section 4.020(C) of Ordinance No.1671-89, as amended (EMC 19.04.020(C)), definition of "Casino, mini," which reads: "Casino, mini" means a business housed in a building containing less than 8,000 square feet which provides gambling and gaming as a primary source of its revenue, which may include food and beverage sales for consumption on the premises as a secondary part of its business activity. Is hereby amended to read: "Casino, mini" means a business which provides gambling and gaming as a primary source of its revenue, which may include food and beverage sales for consumption on the premises as a secondary part of its business activity.
