1 <br /> 2 • WSDOT considers and recognizes a regular dealer, as a firm that <br /> 3 owns, operates, or maintains a store, warehouse, or other <br /> 4 establishment in which the materials or supplies required for the <br /> 5 performance of the Contract and described by the specifications of <br /> 6 the Contract are bought, kept in stock and regularly sold or leased <br /> 7 to the public in the usual course of business. <br /> 8 <br /> 9 • Sixty percent (60%) of the cost of materials or supplies purchased <br /> 10 from an approved regular dealer may be credited as DBE <br /> 11 participation. <br /> 12 <br /> 13 Regular dealer status is granted on a contract-by-contract basis. A firm <br /> 14 wishing to be approved as a regular dealer for WSDOT contracted <br /> 15 projects or Highways & Local Program administered projects must submit <br /> 16 a request in writing to OEO for approval, no later than seven days prior to <br /> 17 bid opening. <br /> 18 <br /> 19 Once the OEO has received the request, an onsite review will be set up <br /> 20 with the firm and a review conducted to determine the firm's qualifications. <br /> 21 If it is determined that the firm qualifies as a regular dealer the OEO will <br /> 22 list the firm on an Approved Regular Dealers List. The list may be <br /> 23 accessed through the OEO Home website is at: <br /> 24 <br /> 25 www.wsdot.wa.gov/equalopportunity. <br /> 26 <br /> 27 Note: Requests to be listed as a regular dealer will only be processed if <br /> 28 the requesting firm is certified by the Office of Minority and <br /> 29 Women's Business Enterprises in a NAICS code that fall within <br /> 30 the 42XXXX NAICS Wholesale code section. <br /> 31 <br /> 32 Materials or Supplies Purchased from a DBE <br /> 33 With regard to materials or supplies purchased from a DBE who is neither <br /> 34 a manufacturer nor a regular dealer you may claim credit for the following: <br /> 35 <br /> 36 1. Fees or commissions charged for assistance in the procurement <br /> 37 of the materials and supplies. <br /> 38 <br /> 39 2. Fees or transportation charges for the delivery of materials or <br /> 40 supplies. <br /> 41 <br /> 42 In either case you may not take credit for any part of the cost of the <br /> 43 materials and supplies. <br /> 44 <br /> 45 Commercially Useful Function (CUF) <br /> 46 The Prime Contractor has a responsibility and must treat the working <br /> 47 relationship with the DBE such that the DBE is performing a commercially <br /> 48 useful function.
