The Prime Contractor and DBE shall be able to provide receipts, 2 invoices, cancelled checks and/or certification statements of payment 3 if requested by the Contracting Agency. 4 f The DBE remains responsible for all other elements of 49 CFR 5 26.55(c)(1). 6 7 Failure by the Prime Contractor to request and receive prior approval of a joint 8 check arrangement will result in the joint check amount not counting towards 9 the Prime Contractor's DBE goal. 10 11 Disadvantaged Business Enterprise Utilization Certification FORM # 272- 12 056 EF 13 To be eligible for award of the Contract, the Bidder shall properly complete and 14 submit a Disadvantaged Business Enterprise Utilization Certification with the 15 Bidder's sealed Bid Proposal, as specified Section 1-02.9 Delivery of 16 Proposal. The Bidder's Disadvantaged Business Enterprise Utilization 17 Certification must clearly demonstrate how the Bidder intends to meet the DBE 18 COA goal. A Disadvantaged Business Enterprise Utilization Certification (form 19 # 272-056 EF) is included in your Proposal package for this purpose as well as 20 instructions on how to properly fill out the form. 21 22 In the event of arithmetic errors in completing the Disadvantaged Business 23 Enterprise Utilization Certification the amount listed to be applied towards the 24 goal for each DBE shall govern and the DBE total amount shall be adjusted 25 accordingly. 26 27 Note: The Contracting Agency shall consider as non-responsive and shall 28 reject any Bid Proposal submitted that does not contain a 29 Disadvantaged Business Enterprise Utilization Certification that 30 accurately demonstrates how the Bidder intends to meet the COA 31 goal. 32 33 Disadvantaged Business Enterprise (DBE) Written Confirmation 34 Document(s) FORM #422-031 EF 35 The Bidder shall submit a complete and accurate Disadvantaged Business 36 Enterprise (DBE) Written Confirmation Document for each DBE firm listed in 37 the Bidder's completed Disadvantaged Business Enterprise Utilization 38 Certification as submitted with the bid. Failure to do so will result in the 39 associated participation being disallowed, which may result in bid rejection. 40 41 A Disadvantaged Business Enterprise (DBE) Written Confirmation Document 42 (form No. 422-031 EF) is included in your Proposal package for this purpose. 43 44 The form(s) shall be received as specified in the special provisions for Section 45 1-02.9 Delivery of Proposal. 46 47 It is prohibited for the Bidder to require a DBE to submit a Written Confirmation 48 Document with any part of the form left blank. Should the Contracting Agency 49 determine that a Written Confirmation Document was signed by a DBE that 50 was not complete; the validity of the document comes into question and the 51 associated DBE Participation may not receive credit.
