rEk."7-7- ORDINANCE NO. 2589-02 AN ORDINANCE providing for the vacation of the alley located in Block 652, and a portion of State Street between Block 651 and Block 652, Plat of Swalwell's 1St Addition WHEREAS, the City Council of the City of Everett, did by Resolution No. 5134 duly adopt and fix the 2nd day of January, 2002 at 8:30A.M., as the date of public hearing; and WHEREAS, due and legal notice of the time and place of said hearing and determination of said Resolution has been given by the City Clerk in the manner prescribed by law; and WHEREAS, at the time and place fixed for hearing, the issues were publicly presented; and WHEREAS, the City Council finds it would not vacate the right-of- way if a utility easement could not be retained; and WHEREAS, the petitioners applied for said right of way vacation after the City of Everett's adoption of Resolution No. 5083 amending the compensation requirements for right of way vacations; and WHEREAS, it now appears to the City Council of the City of Everett that the said right-of-way resolved to be vacated should be vacated pursuant to the terms and conditions of this ordinance; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the following described right-of-way: All that portion of the Plat of Swalwell's 1st Addition to Everett, according to the plat thereof, recorded in Volume 2 of Plats, Page 103, records of Snohomish County, Washington; described as follows: BEGINNING at the Southwest corner of Lot 30, Block 652 of said plat; THENCE, East along the South line of said Lot 30 to intersect the Southerly right of way line of the Eastbound On-ramp from Interstate Highway 5 to U.S. Highway 2; THENCE, Southeasterly along said Southerly right of way line to intersect the West line of Lot 10, Block 651 of said plat; THENCE, South along said West line of said lot to the Southwest corner thereof, and the Northerly right of way line of Hewitt
