rEk."7-7- <br /> ORDINANCE NO. 2589-02 <br /> AN ORDINANCE providing for the vacation of the <br /> alley located in Block 652, and a portion of State Street <br /> between Block 651 and Block 652, Plat of Swalwell's 1St <br /> Addition <br /> WHEREAS, the City Council of the City of Everett, did by Resolution No. 5134 <br /> duly adopt and fix the 2nd day of January, 2002 at 8:30A.M., as the date of public <br /> hearing; and <br /> WHEREAS, due and legal notice of the time and place of said hearing and <br /> determination of said Resolution has been given by the City Clerk in the manner <br /> prescribed by law; and <br /> WHEREAS, at the time and place fixed for hearing, the issues were publicly <br /> presented; and <br /> WHEREAS, the City Council finds it would not vacate the right-of- way if a utility <br /> easement could not be retained; and <br /> WHEREAS, the petitioners applied for said right of way vacation after the City of <br /> Everett's adoption of Resolution No. 5083 amending the compensation requirements <br /> for right of way vacations; and <br /> WHEREAS, it now appears to the City Council of the City of Everett that the said <br /> right-of-way resolved to be vacated should be vacated pursuant to the terms and <br /> conditions of this ordinance; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: <br /> That the following described right-of-way: <br /> All that portion of the Plat of Swalwell's 1st Addition to Everett, according to the plat <br /> thereof, recorded in Volume 2 of Plats, Page 103, records of Snohomish County, <br /> Washington; described as follows: <br /> BEGINNING at the Southwest corner of Lot 30, Block 652 of said plat; <br /> THENCE, East along the South line of said Lot 30 to intersect the <br /> Southerly right of way line of the Eastbound On-ramp from Interstate <br /> Highway 5 to U.S. Highway 2; THENCE, Southeasterly along said <br /> Southerly right of way line to intersect the West line of Lot 10, Block 651 <br /> of said plat; THENCE, South along said West line of said lot to the <br /> Southwest corner thereof, and the Northerly right of way line of Hewitt <br />
