• AMENDMENT NO. 1 TO PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF EVERETT AND MURRAY, SMITH& ASSOCIATES, INC. Legion Golf Course Stormwater Detention Project, UP3620 The City and Murray, Smith & Associates, Inc. agree to amend and modify their professional services agreement dated August 25, 2015 (the"Agreement")as follows: 1. The effective date of this Amendment is(month) , (day) , (year) 2. Part 1 (Paragraph 1 of Exhibit A): The work included in Exhibit C-1 of this amendment is added to the Scope of Work described in Exhibit C of the Agreement. 3. Part 3 (Paragraph 3 of Exhibit A)is revised to read as follows: Date of Contract Completion:December 31,2018. 4. Part 4 (Paragraph 4D of Exhibit A)is revised to read as follows: Maximum Total Compensation Amount: $798,867. 5. Part 4(Paragraph 4B of Exhibit A)is modified to read as follows: The Contractor shall be paid such amounts and in such manner as described in Exhibit D of the Agreement and Exhibit D-1 of this amendment. 6. Part 4 (Paragraph 4C of Exhibit A) References to Exhibit D in this paragraph shall be replaced with "Exhibit D and Exhibit D-1 of Amendment No. 1". 7.
