2) The proposed land use designation does promote a more desirable land use pattern <br /> for the community as a whole in that it needed housing and educational facilities for those <br /> in need in a location that will tend to facilitate there use. Thus the proposed change in the <br /> land use designation is in the greater community's interest; and <br /> 3) Through this action the City is not providing a special grant or privilege to the <br /> applicant, rather it is acting to facilitate the provision of needed social services that <br /> benefit the community as a whole; and <br /> 4) Pressure to change the land use designation of other properties in the vicinity <br /> outside the present location should be discouraged. However, due to the demand for and <br /> location of this proposed use, it is in the best long term interests of the community to <br /> allow it if the previously stated restrictions and conditions are meet; and <br /> 5) The purpose for the requested land use map amendment is to allow for the <br /> construction of housing and an educational facility for non commercial use only, without <br /> any other B-2 zone use of the property; and <br /> 6) The applicant has offered, in testimony before the Planning Commission, a desire <br /> to meet the platting, site use and access conditions applied to the subject site; and <br /> 7) The requested amendment to the land use map and rezone promotes the public <br /> health, safety and welfare and the long term interests of the Everett Community provided <br /> development of the subject property is conditioned according to the stipulations, <br /> restrictions and provisions found herein. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Land Use Map amended: The Everett Comprehensive Plan map land use <br /> designation for the Housing Hope property located at 5830 Evergreen Way, as depicted <br /> on the attached"Exhibit A," and who's legal description is, <br /> THAT PORTION OF LOTS 1,2, and 3, BLOCK 6, BEVERLY HILLS DIVISION <br /> NO. 4 ACCORDING TO THE PLAT THEREOF RECORDED IN VOLUME 10 <br /> OF PLATS, PAGE 97, IN SNOHOMISH COUNTY, DESCRIBED AS <br /> FOLLOWS: beginning at the Northesast corner of said lotl; THENCE S. 16°40' <br /> 41" 61.51 feet to the point of curvature of a curve left, whose radial center bears <br /> S. 73°19'19"E., 3,098.53 feet; THENCE along said curve to the left, an arc <br /> distance of 149.33 feet, through a central angle of 02°45'41"; THENCE N. <br /> 76°08'01" W., 92.45 feet; THENCE N. 14°13'51"E., 215.52 feet; THENCE S., <br /> 73°19'19" 97.94 feet to the POINT OF BEGINNING. SITUATE IN THE CITY <br /> OF EVERETT, COUNTY OF SHOHOMISH, STATE OF WASHINGTON. <br /> CONTAINING APPROXIMATELY 20,084 SQARE FEET, <br /> 3 <br />
