ORDINANCE NO. 2602-02 <br /> AN ORDINANCE amending the City's tow regulations concerning <br /> public impounds, amending Sections 10 and 12 of Ordinance No. 1830-91 <br /> (EMC 5.70.100 and 5.70.110) <br /> Whereas, the City's tow regulations distinguish between private impounds, public <br /> impounds and police impounds; and <br /> Whereas, the Police Department maintains a list of qualified licensees for purposes <br /> of performing police impounds. Impounds that are not police originated and are on <br /> private property can be performed by any tow business licensed by the City. <br /> Impounds that originate on public property initiated by a city official other than <br /> police are public impounds and like private impounds, can be performed by any tow <br /> business licensed by the City; and <br /> Whereas, it is the intent of this ordinance to confirm that public impounds are not <br /> restricted to the same process and list of qualified licensees set forth in EMC <br /> 5.70.110 as are police impounds; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 10 of Ordinance No. 1830-91 (EMC 5.70.100) which reads as <br /> follows: <br /> Licensees authorized for private impounds. <br /> A "private impound," for purposes of this chapter, means the vehicle has been <br /> impounded at the direction of a person having control or possession of the private <br /> property upon which the vehicle was located. All licensees are authorized to do <br /> private impounds. <br /> BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: <br /> Licensees authorized for private and public impounds. <br /> A "private impound," for purposes of this chapter, means the vehicle has been <br /> impounded at the direction of a person having control or possession of the private <br /> property upon which the vehicle was located.
