9.9 Access Channel Assignments <br /> Grantee will use reasonable efforts to minimize the movement of Access Channel <br /> assignments. Grantee shall also use reasonable efforts to institute common Access Channel <br /> assignments among communities throughout the Seattle metropolitan area for compatible Access <br /> programming, for example, by assigning all Educational Access Channels programmed by higher <br /> education organizations to the same Channel number(s). <br /> 9.10 Relocation of Access Channels <br /> Grantee shall provide the City with a minimum of ninety (90) days notice, and use its best <br /> efforts to provide one hundred twenty (120) days notice, prior to the time any Access Channel <br /> designation is changed, unless the change is required by federal law, in which case Grantee shall <br /> give the City the maximum notice possible. In addition, Grantee, at its expense, shall actively assist <br /> the City in remarketing and advertising any change of an Access Channel designation. Grantee, at <br /> Grantee's expense, will place the City's notices of the Channel change on or with its regular <br /> monthly billings, upon the City's request. Any new Access Channels provided pursuant to this <br /> Franchise shall be in full compliance with FCC signal quality and proof-of-performance standards. <br /> 9.11 Interconnections <br /> Grantee acknowledges that is the City's goal to further the community's needs and interests <br /> by providing for the interconnection of Access Channels between the City and surrounding <br /> communities. Therefore, Grantee will implement the Access Channel interconnections, which <br /> facilitate the sharing of Access programming between and among the City and surrounding <br /> (geographically adjacent) communities. The City shall have the right to use any Access <br /> programming provided to it through an interconnect. <br /> 9.12 Return Lines <br /> Grantee shall, at its expense, continuously maintain throughout the term of this Franchise <br /> return lines to the headend from the demarcation points at City Hall and the Parks Department's <br /> headquarters in order to enable the distribution of Access programming to Residential Subscribers <br /> on the Access Channels. <br /> 9.13 Repair and Replacement <br /> The Grantee shall provide routine maintenance and shall repair and replace all of Grantee's <br /> transmission equipment as necessary to carry a quality signal from the Access facilities to <br /> Subscribers. <br /> Page 33 of 58 <br />
