Temporary Construction Easement ��'FIT Tax Account Number: 91-6001248 ABBREVIATED LEGAL DESCRIPTION: TEMPORARY CONSTRUCTION EASEMENT THIS TEMPORARY CONSTRUCTION EASEMENT (this "Agreement") is made this ,T" day of -3-''/NV' , 2016, by and among between the Port of Everett, a Washington port district (hereinafter referred to as "Grantor"), and the City of Everett, a municipal corporation under the laws of the State of Washington, (hereinafter referred to as "City") as Grantee, on behalf of itself and its successors and assigns. Grantor is the owner of certain real property known as the Port of Everett Marine Terminal, as more particularly described on Exhibit"A" attached hereto (hereafter referred to as the "Property"), and is executing this Agreement on behalf of itself and its successors and assigns. By separate Easement Agreement, the Grantor will grant to the City a permanent sewer overflow easement commonly referred to as the PSO No. 6. In order to install and reconstruct PSO No. 6 and utilize the granted easement area, it will be necessary for the City to have a temporary construction easement over certain portions of the Port's property. For these reasons,the Port has agreed to grant this Agreement to the City.
