• <br /> After recording mail to: <br /> City of Everett <br /> Real Property Manager <br /> 3200 Cedar Street <br /> Everett, WA 98201 <br /> W.O. #3583 <br /> PSO No. 6 <br /> "? <br /> Temporary Construction Easement <br /> ���'FIT <br /> Tax Account Number: 91-6001248 <br /> ABBREVIATED LEGAL DESCRIPTION: <br /> TEMPORARY CONSTRUCTION EASEMENT <br /> THIS TEMPORARY CONSTRUCTION EASEMENT (this "Agreement") is made this <br /> ,T" day of -3-''/NV' , 2016, by and among between the Port of Everett, a <br /> Washington port district (hereinafter referred to as "Grantor"), and the City of Everett, a <br /> municipal corporation under the laws of the State of Washington, (hereinafter referred to as <br /> "City") as Grantee, on behalf of itself and its successors and assigns. <br /> Grantor is the owner of certain real property known as the Port of Everett Marine <br /> Terminal, as more particularly described on Exhibit"A" attached hereto (hereafter referred to <br /> as the "Property"), and is executing this Agreement on behalf of itself and its successors and <br /> assigns. <br /> By separate Easement Agreement, the Grantor will grant to the City a permanent sewer <br /> overflow easement commonly referred to as the PSO No. 6. In order to install and reconstruct <br /> PSO No. 6 and utilize the granted easement area, it will be necessary for the City to have a <br /> temporary construction easement over certain portions of the Port's property. For these <br /> reasons,the Port has agreed to grant this Agreement to the City. <br /> In consideration of mutual benefits to be derived and in consideration of and subject to <br /> the performance of the covenants, terms and conditions hereinafter set forth, Grantor hereby <br /> conveys and warrants to the City, subject to the terms and conditions contained herein, and <br /> during the period of initial installation and construction of a combined sanitary and <br /> stormwater transmission pipeline under the terms and provisions of the Agreement, as <br />
