I <br /> 1 parties cannot agree, the Owner's Representative will determine the amount of <br /> 2 the adjustment of Contract Sum in accordance with section 1-09.4 Equitable <br /> 3 Adjustment; <br /> 4 3. To the extent not paid for by the Contract Sum for the completed units of work, <br /> 5 the Owner will pay as part of the adjustment of Contract Sum those direct costs <br /> 6 necessarily and actually incurred by the Contractor in reasonable anticipation of <br /> 7 performing the work that has been deleted or terminated; <br /> 8 4. The total payment for any one item in the case of a deletion or partial termination I <br /> 9 shall not exceed the bid price as modified by approved Change Orders less the <br /> 10 estimated cost (including overhead and profit) to complete the work and less any <br /> 11 amount paid to the Contractor for the item; <br /> 12 5. If the entire remainder of the Contract is terminated, the total payment to the <br /> 13 Contractor shall not exceed the total Contract Sum as modified by approved <br /> 14 Change Orders less those amounts paid to the Contractor before the effective <br /> 15 date of the termination; and <br /> 16 6. No claim for damages of any kind or for loss of anticipated profits or <br /> 17 consequential damages on deleted or terminated work will be allowed because of <br /> I <br /> 18 termination or Change Order. Contract Time shall be adjusted as the parties <br /> 19 agree. If the parties cannot agree, the Owner's Representative will determine the <br /> 20 adjustment of Contract Time. <br /> 21 <br /> 22 Acceptable materials ordered by the Contractor prior to the date the work was <br /> 23 terminated or deleted will either be purchased from the Contractor by the Owner at the <br /> 24 actual cost and shall become the property of the Owner, or the Owner will reimburse the <br /> 25 Contractor for the actual costs of returning these materials to the suppliers. <br /> 26 <br /> 27 If Contractor disagrees with the adjustment of Contract Sum determined by the Owner's <br /> I <br /> 28 Representative, Contractor may submit a Contract Claim for the difference between the <br /> 29 amount determined by the Owner's Representative and the amount sought by the <br /> 30 Contractor. Ill31 <br /> 32 Contractor shall not be entitled to any anticipated profits on deleted, terminated, or <br /> 33 uncompleted work will be allowed. <br /> 34I <br /> 35 1-09.7 Mobilization <br /> 36 <br /> 37 Section 1-09.7 is modified by adding the following: I <br /> 38 Construction Identification Signs: Upon commencement of work, the Contractor shall <br /> 39 furnish and erect two Construction Identification Signs, one at each end of each work <br /> 40 area, locations of the signs shall be approved by the Engineer. <br /> 41 Sign painting, letter and detailing shall be done by a professional sign maker and <br /> 42 approved by Engineer prior to placement on job site. <br /> 43 The signs shall be made from three-quarter inch M.D.O. (Medium Density Overlay or <br /> 44 Dura-ply) plywood and conform to the dimensions shown on the "Construction <br /> 45 Identification Sign" detail on Standard Plan No. 712. Each of the two Construction <br /> 46 Identification Signs shall have a "Project Information Sign" plan attached to the surface <br /> 47 of the sign face per Standard Plan No. 713.
