BACKGROUND I tFORMATION: The City is often asked to rule on what constitutes a kitchen, either during the building permit application review,or during code enforcement proceedings;when non- permitted units have been added to residential buildings. This is a critical determination as the number of kitchens establishes the number of dwelling units within a building,therefore,the residential density permitted on a property. ' AUTHORITY: EMC 19.41.040 authorizes the planning director"to promulgate administrative rules, procedures and interpretations consistent with the terms of this title:" EMC 19.4.020"Zoning Code definitions,specific"does not define the term"kitchen". This section of the code defines terms used in the Zoning Code,"which may have a different meaning or connotation than ordinarily associated with such terms." . • ADMINISTRATIVE INTERPRRETATION: Pursuant to the authority granted by EMC 19.41.040 of the Zoning Code,the following administrative interpretation is made and is establishes defined standards for what constitutes a kitchen or kitchens in a residential structure. "Kitchen"means any room(s), used or designed to be used for cooking or the preparation offood and having provisions available for an installed gas or electric stove or range(microwave is not considered a range or oven);a kitchen sink(hand sink or utility sink are not to be considered kitchen sinks)and/or dishwasher;and/or plumbing or standpipes for equipment and facilities normally found in a kitchen.. Single family dwellings, with the exception of those containing a city approved accessoi y dwelling unit, shall be limited to one kitchen. A second stove, oven, or kitchen sink shall not be permitted in single- family dwellings.
