I <br /> CITY OF EVERETT PUBLIC WORKS DOCUMENT 00 72 13 1 <br /> SPECIAL PROVISIONS GENERAL CONDITIONS <br /> 13. Contract Sum: The price in dollars stated in the Contract to be paid by the Owner to the I <br /> Contractor for the Work described in the Contract Documents, as modified by any Change <br /> Orders. <br /> 14. Contract Time: The duration of the Project as stated in the Contract and as modified by I <br /> any Change Orders. <br /> 15. Contractor: The individual or entity with whom Owner has entered into the Agreement. <br /> 16. Day: Calendar day,unless explicitly stated otherwise. <br /> 17. Delay: Any increase of the duration of the critical path of the Project. <br /> 18. Dispute: Any controversy or disagreement. I <br /> 19. Drawings: That part of the Contract Documents that graphically shows the scope, extent, <br /> and character of the Work to be performed by Contractor. Shop Drawings and other <br /> Contractor Submittals are not Drawings as so defined. <br /> 20. Effective Date of Agreement: See 18.10 Effective Date. <br /> 21. Engineer: An individual or entity retained by the Owner to be the Owners representative <br /> with regard to matters of design intent. The terms "Owner's Representative", "Engineer" <br /> and"Architect"are interchangeable. <br /> 22. Equipment: Mechanical, electrical, instrumentation, or other devices with one or more I <br /> moving parts, or devices requiring an electrical, pneumatic, electronic, or hydraulic <br /> connection. <br /> 23. Extended Overhead: The increase in Overhead costs attributable to an extension of 1 <br /> Contract Time. <br /> 24. Extra Work: Providing materials and Equipment and the performance of Work not directly <br /> called for in, or implied by, the Contract Documents,such that Contractor would be entitled <br /> to an adjustment of Contract Sum and possibly an extension of Contract Time. <br /> 25. Field Order: A written order issued by Owner's Representative that requires minor changes <br /> in the Work,but does not involve a change in the Contract Sum or the Contract Time. <br /> 26. Final Acceptance: Formal action by Everett City Council determining that all of the <br /> Contractor's Work has been completed,except for any landscaping maintenance. <br /> 27. Float: The amount of time between the early start date and the late start date, or the early <br /> finish date and the late finish date of any activity in the project schedule. <br /> 28. Force Account: Costs of performing Work as defined in 9.6.Force Account. I <br /> 29. Furnish, Install, Perform, Provide, Supply: The word "Furnish" or the word "Install" or <br /> the word "Perform" or the word "Provide" or the word "Supply," or any combination or <br /> similar directive or usage thereof, shall mean furnishing and incorporating in the Work <br /> including all necessary labor, materials, equipment, and everything necessary to perform the <br /> Work indicated,unless specifically limited in the context used. <br /> 30. General Conditions: This Section 007213 of the Contract Documents. <br /> 31. May: Conduct that is permitted,but not required. <br /> 32.
