I CITY OF EVERETT PUBLIC WORKS DOCUMENT 00 72 13 1 SPECIAL PROVISIONS GENERAL CONDITIONS 13. Contract Sum: The price in dollars stated in the Contract to be paid by the Owner to the I Contractor for the Work described in the Contract Documents, as modified by any Change Orders. 14. Contract Time: The duration of the Project as stated in the Contract and as modified by I any Change Orders. 15. Contractor: The individual or entity with whom Owner has entered into the Agreement. 16. Day: Calendar day,unless explicitly stated otherwise. 17. Delay: Any increase of the duration of the critical path of the Project. 18. Dispute: Any controversy or disagreement. I 19. Drawings: That part of the Contract Documents that graphically shows the scope, extent, and character of the Work to be performed by Contractor. Shop Drawings and other Contractor Submittals are not Drawings as so defined. 20. Effective Date of Agreement: See 18.10 Effective Date. 21. Engineer: An individual or entity retained by the Owner to be the Owners representative with regard to matters of design intent. The terms "Owner's Representative", "Engineer" and"Architect"are interchangeable. 22. Equipment: Mechanical, electrical, instrumentation, or other devices with one or more I moving parts, or devices requiring an electrical, pneumatic, electronic, or hydraulic connection. 23. Extended Overhead: The increase in Overhead costs attributable to an extension of 1 Contract Time. 24. Extra Work: Providing materials and Equipment and the performance of Work not directly called for in, or implied by, the Contract Documents,such that Contractor would be entitled to an adjustment of Contract Sum and possibly an extension of Contract Time. 25. Field Order: A written order issued by Owner's Representative that requires minor changes in the Work,but does not involve a change in the Contract Sum or the Contract Time. 26. Final Acceptance: Formal action by Everett City Council determining that all of the Contractor's Work has been completed,except for any landscaping maintenance. 27. Float: The amount of time between the early start date and the late start date, or the early finish date and the late finish date of any activity in the project schedule. 28. Force Account: Costs of performing Work as defined in 9.6.Force Account. I 29. Furnish, Install, Perform, Provide, Supply: The word "Furnish" or the word "Install" or the word "Perform" or the word "Provide" or the word "Supply," or any combination or similar directive or usage thereof, shall mean furnishing and incorporating in the Work including all necessary labor, materials, equipment, and everything necessary to perform the Work indicated,unless specifically limited in the context used. 30. General Conditions: This Section 007213 of the Contract Documents. 31. May: Conduct that is permitted,but not required. 32. Milestone: A principal event specified in the Contract documents relating to an intermediate completion date or time prior to Substantial Completion of all the Work.
