t <br /> CITY OF EVERETT PUBLIC WORKS DOCUMENT 00 72 13 <br /> SPECIAL PROVISIONS GENERAL CONDITIONS <br /> 53. Subcontractor: An individual or entity having a direct contract with Contractor or with any <br /> other Subcontractor for the performance of a part of the Work. <br /> 54. Submittals: The information required by the Contract Documents provided by Contractor <br /> to the Owner's Representative or Owner. <br /> 55. Substantial Completion: The day on which the Owner or Owner's Representative <br /> determines the Owner has full and unrestricted use and benefit of the Project, from both the <br /> operational and safety standpoints and only minor incidental Work, replacement of <br /> temporary substitute facilities, or minor correction or repair Work remains. Determination <br /> of Substantial Completion in whole or in part is solely at the discretion of the Owner. <br /> Substantial Completion does not mean complete in accordance with the Contract nor shall <br /> Substantial Completion of all or any part of the Project entitle the Contractor to Final <br /> Acceptance under the Contract. <br /> 56. Supplier: A manufacturer, fabricator, supplier, distributor, materialman,or vendor having a <br /> direct contract with Contractor or with any Subcontractor to furnish materials or Equipment <br /> to be incorporated in the Work. <br /> 57. Total Float: The amount of time any given activity or path of activities may be delayed <br /> before it will affect the Completion Date. <br /> 58. Traffic: Both vehicular and non-vehicular traffic, such as pedestrians, bicyclists, <br /> wheelchairs,and equestrian traffic. <br /> 59. Unabsorbed Overhead: The reduction or loss of contribution to recovery of the <br /> Contractor's Overhead costs realized by the result of reduced Project or Contractor billings, <br /> or both,due to any reason whatsoever,including a Project extension. <br /> 60. Unit Price Work: Refers to items of Work identified by unit prices in the bid form. <br /> 61. Work: Refers to the Project and the labor, materials, Equipment, supplies, services, and <br /> other items necessary for the execution,completion and fulfillment of the Contract. <br /> 1.2 Contract Documents <br /> A. The complete Contract includes: <br /> 1. Federal requirements that apply to this Contract and Project; <br /> 2. Supplemental agreements between Owner and Contractor, if any, subsequent to the Owner's <br /> execution of the Contract; <br /> 3. Addenda; <br /> 4. The Contract; <br /> 5. Specifications, including, but not limited to, these General Conditions and other numbered <br /> Sections; <br /> 6. Supplementary Conditions,if any; <br /> 1 7. Drawings; <br /> 8. Change Orders; <br /> 1 9. City of Everett standard plans in effect as of the date Bids are opened; <br /> 10.
