• <br /> "OW <br /> ORDINANCE NO. 2620-02 <br /> AN ORDINANCE Relating to Abandonment of Dependent Persons, <br /> Amending Section 1 of Ordinance No. 2468-00, (EMC 10.19.010) and <br /> Amending Section 6 of Ordinance No. 2468-00 (EMC 10.19.060). <br /> WHEREAS, in 2000 the City Council of the City of Everett found that there is a <br /> significant need to protect children and dependent persons from abuse and neglect by <br /> their parents,by persons entrusted with their physical custody, or by persons employed to <br /> provide them with the basic necessities of life; and <br /> WHEREAS,based upon these findings, the City Council of the City of Everett adopted a <br /> law consistent with the state gross misdemeanor crime of Abandonment of a Dependent <br /> Person in the Third Degree; and <br /> WHEREAS, in 2002, with the stated intent of assuring prevention of abandonment and to <br /> assure that all newborns have an opportunity for adequate health care and a stable home <br /> life, the Legislature of the State of Washington added an exemption to the crime of <br /> Abandonment of a Dependent Person for parents of newborns who transfer the newborn <br /> to a qualified person at an appropriate location; and <br /> WHEREAS, the City of Everett City Council deems it appropriate for the City Criminal <br /> Code to be consistent with state law in this area; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 1 of Ordinance No. 2468-00 (EMC 10.19.010), which reads as <br /> follows: <br /> Definitions. <br /> The definitions in this section apply throughout this chapter unless the context clearly <br /> requires otherwise. <br /> 1. "Basic necessities of life" means food,water, shelter, clothing, and medically <br /> necessary health care, including but not limited to health-related treatment or <br /> activities, hygiene, oxygen, and medication. <br /> 2. (a) "Bodily injury"means physical pain or injury, illness, or an impairment of <br /> physical condition; <br />
