• "OW ORDINANCE NO. 2620-02 AN ORDINANCE Relating to Abandonment of Dependent Persons, Amending Section 1 of Ordinance No. 2468-00, (EMC 10.19.010) and Amending Section 6 of Ordinance No. 2468-00 (EMC 10.19.060). WHEREAS, in 2000 the City Council of the City of Everett found that there is a significant need to protect children and dependent persons from abuse and neglect by their parents,by persons entrusted with their physical custody, or by persons employed to provide them with the basic necessities of life; and WHEREAS,based upon these findings, the City Council of the City of Everett adopted a law consistent with the state gross misdemeanor crime of Abandonment of a Dependent Person in the Third Degree; and WHEREAS, in 2002, with the stated intent of assuring prevention of abandonment and to assure that all newborns have an opportunity for adequate health care and a stable home life, the Legislature of the State of Washington added an exemption to the crime of Abandonment of a Dependent Person for parents of newborns who transfer the newborn to a qualified person at an appropriate location; and WHEREAS, the City of Everett City Council deems it appropriate for the City Criminal Code to be consistent with state law in this area; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: Section 1 of Ordinance No. 2468-00 (EMC 10.19.010), which reads as follows: Definitions. The definitions in this section apply throughout this chapter unless the context clearly requires otherwise. 1. "Basic necessities of life" means food,water, shelter, clothing, and medically necessary health care, including but not limited to health-related treatment or activities, hygiene, oxygen, and medication. 2. (a) "Bodily injury"means physical pain or injury, illness, or an impairment of physical condition;
