S <br /> ..l <br /> ORDINANCE NO. 2623-02 <br /> AN ORDINANCE Relating to Making and Having Burglar Tools, Amending <br /> Section 45 of Ordinance No. 1145-85 (EMC 10.68.020). <br /> WHEREAS, the City Council of the City of Everett has been advised by the Everett <br /> Police Department that police officers are routinely detaining people with rings of <br /> "shaved keys"in their pockets; and <br /> WHEREAS, the City Council of the City of Everett has been further advised by the <br /> Everett Police Department that shaved keys are used to start several different models and <br /> makes of vehicles, and are usually used for stealing the cars; and <br /> WHEREAS, the City Council of the City of Everett deems it appropriate to criminalize <br /> the possession of shaved keys under circumstances evincing an intent to use or employ, <br /> or allow the same to be used or employed in the commission of a crime; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 45 of Ordinance No. 1145-85 (EMC 10.68.020), which reads as <br /> follows: <br /> Making or having burglar tools. <br /> A. Every person who shall make or mend or cause to be made or mended, or have in his <br /> possession, any engine, machine, tool, false key, pick lock, bit, nippers, or implement <br /> adapted, designed, or commonly used for the commission of burglary, as defined in RCW <br /> Chapter 9A.52, under circumstances evincing an intent to use or employ, or allow the <br /> same to be used or employed in the commission of a burglary, or knowing that the same <br /> is intended to be so used, shall be guilty of making or having burglar tools. <br /> B. Making or having burglar tools is a gross misdemeanor. <br /> is hereby amended to read as follows: <br /> Making or having tools commonly used for the commission of burglary or other crime. <br /> A. Every person who shall make or mend or cause to be made or mended, or have in his <br /> possession, any engine, machine, tool, false key, shaved key, pick lock, bit, nippers, or <br />
