Ordinance No. 2624-02 <br /> An Ordinance amending the City's fireworks regulations <br /> to comply with Second Substitute Senate Bill 6080, Chapter 370, <br /> Laws of 2002, amending Ordinance No.1041-84 as amended <br /> by Ordinance No's. 1146-85 and 2179-96 (Chapter 16.60 EMC) <br /> Whereas, in the 2002 Legislative Regular Session, the Second Substitute Senate Bill <br /> 6080, Chapter 370 was adopted which amended the State regulations concerning <br /> fireworks; and <br /> Whereas, it is the intent of this ordinance to amend the City's fireworks regulations to <br /> bring them into compliance with the recently adopted State fireworks regulations; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 1 of Ordinance No. 1041-84 (EMC 16.60.010) which reads as <br /> follows: <br /> EMC 16.60.010 Definitions. <br /> For the purpose of this chapter, the following words shall mean: <br /> A. "Agricultural and wildlife fireworks" means fireworks devices distributed to farmers, <br /> ranchers and growers through a wildlife management program administered by the <br /> United States Department of the Interior. <br /> B. "Common fireworks" means any fireworks designed primarily to produce visual or <br /> audible effect by combustion. <br /> 1. The term includes: <br /> a. Ground and hand-held sparkling devices, including items commonly known as dipped <br /> sticks, sparklers, cylindrical fountains, cone fountains, illuminating torches, wheels, <br /> ground spinners, and flitter sparklers; <br /> b. Smoke devices; <br /> c. Helicopters containing not more than twenty grams of pyrotechnic composition, <br /> aerials, spinners, roman candles, mines and shells; <br /> d. Class C explosives classified on January 1, 1984, as common fireworks by the United <br /> States Department of Transportation. <br />
