On October 13, 2014, ECE Officer Wathen spoke with the Respondent and he <br /> informed her that he hauled the garbage to the dump himself and he would remove <br /> the bagged garbage from the alley. (Testimony of Code Enforcement Officer <br /> Wathen) <br /> 9. On October 14, 2014, ECE Officer Wathen reinspected the property and observed <br /> and photographed that the condemnation notice had been removed and the bagged <br /> garbage remained discarded in the alley. On November 4, 2014, City of Everett Police Chief Templeman contacted the ECE <br /> unit concerning claims received by his department that the property was occupied <br /> without required water and electrical services. City of Everett Police Sgt. Jessup <br /> confirmed with the Respondent that the residential structure had no electrical <br /> service and that the garage structure on site was occupied. (Exhibit#13, Email from <br /> Kevin Fagerstrom dated November 5, 2014) (Testimony of Code Enforcement <br /> Officer Wathen) <br /> 11. On November 6, 2014, ECE Officer Wathen reinspected the property and observed <br /> and photographed that the shopping carts remained on the sidewalk in front of the <br /> property but the bagged garbage had been removed from the alley. (Exhibit#1a-1b, <br /> Inspection Photos dated November 6, 2014) (Testimony of Code Enforcement <br /> Officer Wathen) <br /> 12. On November 24, 2014, Marci Staats, City of Everett Utilities Department, informed <br /> ECE Officer Wathen that water service to the residential structure had been turned <br /> off for nonpayment. The turnoff date was November 12, 2014. ECE Officer Wathen <br /> confirmed with Public Utility District (PUD) that electrical service to the structure <br /> remained off. (Exhibit#14, Email from Marcy Staats dated November 24, 2014) <br /> (Testimony of Code Enforcement Officer Wathen) <br /> 13. The City provided the Respondent with an opportunity to correct the conditions that <br /> are in violation of sections of the EMC and provided notice of the date, time and <br /> place of this hearing. The Respondent failed to appear at the hearing. <br /> Based on the above Findings of Fact, the Violations Hearing Examiner enters the <br /> following Conclusions: <br /> CONCLUSIONS OF LAW <br /> Jurisdiction: <br /> Pursuant to Chapter 1.20 EMC or any Everett Municipal Code (EMC) provisions that <br /> identify Chapter 1.20 EMC for enforcement, the Violations Hearing Examiner of the City <br />
